Parents visa

Hi,

My friend was married to a British Citizen (settled outside UK) but they divorced after 3 years. They have a Son (now aged 8 years) who have a British Passport. My friend have a sole custody of a child.

She came to UK on a visit visa and want to remain in UK. Her Son is now going to school here. Her visit visa is still valid for another month.

My questions is that can she apply for Parent route and does she need to meet English language and Financial Requirements? If yes then what are chances of getting the visa?

Can anyone please advise.

She needs to apply for a Parent of a Child at School visa. Here's the link;

However, she is unable to switch from a visitor visa from within the UK. She will have to return to her home country and apply from there. It's essential that she doesn't overstay her visitor visa as this would have an adverse affect on future visa applications.

That category is for children who are in independent fee-paying school whereas her son is going to government school and do not pay any fees as he is British citizen.

Is there any other category through which she can settle in UK based on her British national son?

She is living with her brother (in UK) and he is currently financially supporting her. So, they both are living in the same house.

You mentioned a son in your first post. Is it the child who is living with a brother or are you referring to the mother?

So they've only been in UK a few months at most?

Mother is living with her brother (Child's uncle) and her child is also living along her. Child's uncle is financially supporting them at the moment.

They have only come to UK few weeks ago and child has just started going to school.

To be honest they'll struggle. Also not sure re: child's entitlement to receive State Education, I'll let others comment on that.

If the son has a British passport then receiving state education is fine. Only category it would seem she would be eligible for is FLR (FP) Family Life as a Parent. Only thing is I don't see how she can avoid becoming an over stayer as you cannot apply as a visitor.
