Passport expired - ILR Application

Hi,

I am writing here as my husband who is the sponsor hasn't slept for 2 days and has stopped eating due to overthinking.

My foreign South Asian Passport expired on 24th April 2024. I have a valid BRP card that expires at the end of December, and on the E Visa login with BRP details that states my immigration expiry date is February, more than the date on BRP. I have a birth certificate from my home country, and national ID card with a slight spelling error of my name.

The high commission provided an appointment of February for new passport which is too late, and my husband spoke to UKIV who advised that we can still apply with an expired passport, so we have and we have a fingerprint appointment with the service point centre with TLS just before the end of December.

The high commission has since given an early appointment for mid December and my husband believes that he can upload the receipt of passport renewal on the application before fingerprint, the application hasn't been submitted yet, just documents have been uploaded and payment been made.

A solicitor also stated that we can apply with expired passport as everything is E visa now, I just would like some responses here to get my husband out of his sad phase and overthinking.

also, another thing to add: national ID and birth certificate will be accepted at the high commission for passport renewal, as when entering the details online, they both link and auto-populate data. My husbands worried during fingerprinting if they ask for anything specific, as on the application it stated national ID mandatory.

I haven't exited the country since arriving here in 2018, its been 5 years and 1 months here, the expired passport still has entry clearance stamp, I haven't been out of this country.

Applicants in the UK need a valid passport to apply as per paragraph 34 of the UK immigration rules. UKVI can exercise discretion as long as 'the applicant' provides a good reason beyond their control why they cannot provide proof of their identity. What you described is a good reason. Also, an expired passport is not an issue for Biometrics enrolment as the UKVCAS accepts different ID documents.

No need for your husband to be worried at all as this is not a big issue at all. Tell him to relax :D

Thank you so much, he has 7 positive answers so far, he’s sleeping and eating well now.

As this is allot of money for us due to two children, this final IRL was supposed to be a stress relief for us, knowing it’s the last one

Hey Zimba, we got a passport renewal slip and uploaded all documents and submitted on the 13th of Dec as proof of renewal. However, we are wondering if we can cancel the UKVAS appointment and do it one month later?


If the documents have been submitted and all we now need to do is book fingerprint UKVAS, do the time sensitive financial documents and everything expire if we prolong the UKVAS fingerprint?

Or as it was submitted on the 13th and all documents were valid during submission, employers letter dated 2nd December, financials etc, is that okay?


We are thinking of being on the safe side to see if we can have the passport in time, but all documents have been submitted

The only date that maters is the application date, the biometrics date is irrelevant
