PBS Dependant married partner

Post by MarkCa » Thu May 12, 2022 2:33 pm

Hello,

I am sponsoring a skilled immigrant worker and he is married. Our intention is that he comes to the UK (he will apply soon), and then once he finds a place where he would like to live, his wife would apply for PBS Dependant visa to join him (approximately one month after he applies).

Will she need any further documents to prove relationship other than their marriage certificate? I am aware that in case of unmarried partner there should be 2 years of proof of living together, however in this case they are legally married so I am not sure if marriage certificate alone is satisfactory.

Thanks!

Certificate with translation if non-English is sufficient

Perfect, thank you. Does it matter when they got married? I think it was a few months ago, and before main applicant even knew that he might start working in the UK (we only got in touch with him about 4 weeks ago), but from perspective of UKVI, can they say that marriage is "too recent" or suspicious because it is too close to traveling?

The recent marriage isn't relevant to to her PBS Dependent application.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Thanks for your response!

Just to clarify:

Isn't relevant meaning:

1. Date itslef is not important - marriage is marriage and has the same weight as evidence regardless of how long it is.

or

2. New marriages are not proof of relationship length and are therefore not relevant to the application.

You certainly are overthinking this.

It doesn't matter when they got married!!

Thanks for the answer!

Yes, I agree, I tend to overthink most of the time when visa is in question. It was the same thing for my personal visa and ILR as well. Thanks once again for your help, I sincerely hope I will get more relaxed about this things as time goes and we sponsor more workers :)
