PBS Dependant to Tier 2 General: CoS while in the UK?

Hi all,

I have a question concerning switching from Tier 2 Dependant to Tier 2 General. I understand there have been various topics on this, but cannot find the answer for my particular question anywhere. So sorry if it is a repeated post.

I am currently in the UK under a Tier 2 Dependant visa to my wife, and now can apply for Tier 2 General. I know that I cannot apply for the new visa in the UK. However, I would like to stay in the UK while my employer apply for the restricted CoS, and once that is done I would go home and apply for the visa there. Am I allowed to do that? My employer does not seem so sure about that, and prefers me to be out of the UK before they request the restricted CoS to the Home Office. But I do not see how and why that matters. At the end of the day, how does the Home Office know if you are in the country or not while your CoS application is being considered?

Really appreciate if someone has the answer or point me to the right direction.

yes. If your employer and future sponsor has any doubts they can call the employer helpline 0300 123 4699 to confirm this
