PBS dependent makes a mistake and applies FLR

Post by supervisual » Mon Aug 09, 2021 3:51 pm

Hi,

My wife accidentally applied for(and got granted) the the FLR Spouse VISA when trying to extend her PBS dependent.

The confusion arose because I had just gotten my ILR which was through the Tier2 Work Permit route and the directions we found were to apply for the Spouse VISA as I am now "settled", which unfortunately meant that her ILR clock got reset, which is frustrating because she had just 2 years more to go on her PBS route.

Note: we would have applied for the ILR at the same time but she was away for 2 years in the US for her masters.

I found some discussion on an old thread: indefinite-leave-to-remain/options-when ... #p1523643 but not sure if it applies.

Just wanted to check if anyone else has had to deal with a similar blunder and what our options are.

Thankyou!

You were advised previously when you asked about your situation: immigration-for-family-members/complica ... l#p1996661

She must now complete 5 years under the family route to be eligible for ILR
