PBS (Tier-2) Dependant Visa about to expire. Which new Visa category to apply for?

Post by ustulation » Wed Jan 05, 2022 12:19 pm

Details (See later for summary):
I was on a Tier-2 (Skilled Worker) General Visa, sponsored by Employer-1 since 2016. In 2018, I applied and brought my spouse to the UK on PBS Dependant Visa. Both our visas were due to expire on 2021 (5 years since the visa of the main applicant, which myself)

In late 2019, I switched employers and got employed with Employer-2. Employer-2 did fresh visas (Visa Extension) for both of us and our new Tier-2 (General and Dependant) visas were due to expire in Feb 2022, since a max of 6 years is allowed (on Tier-2) since 2016 for the main applicant which is myself.

In 2021 however, it was 5 years since I was in the UK on Tier-2 General, so I applied for ILR and got it. Consequently I now have a settled status since. The Home Office rules however allow the spouse to continue on their current Tier-2 Dependant visa even though the partner (myself) has changed to ILR. So my spouse continues to hold the PBS (Tier-2) Dependant visa, which will expire shortly in Feb 2022.

In summary, the situation now is:
- I am on ILR (settled status)

- My spouse is on PBS (Skilled Worker/Tier-2) Dependant visa based off my previous Tier-2 General Visa. Spouse's Dependant Visa is about to expire on Feb 2022.

- My spouse 1st came to the UK in 2018, so it's 3 years and some months they have been in the UK. So my spouse still has 2 years to apply for ILR.

- In the meantime their current Tier-2 Dependant visa is expiring on Feb 2022

Questions:
1. Given this, which visa does my spouse need to apply to remain in the UK after Feb 2022?
2. How soon/late can this visa be applied for? Please consider 27 Feb 2022 as the expiry date of the current visa/BRP they hold
3. We did not need UK-NARIC/ENIC when we applied for the previous Tier-2 Dependant Visas since the College Degree Certificate was enough. However I needed ENIC for ILR. Will my spouse need one too for the next visa? Can you please let me know where this guidance is depending on the visa that you suggest in question (1) above.

1. Skilled Worker Dependent extension https://www.gov.uk/skilled-worker-visa/ ... d-children
2. Apply before BRP expiry. She will get a 3 year extension from the decision date.
3. PBS dependents do not have language requirements when applying for extension. However, they need B1 level for their ILR application later.

Thank you!

There is a section which asks:
> Have you ever been given medical treatment in the UK? Were you told you had to pay the hospital/surgery/clinic for your treatment (Do not include IHS)?

And then further down about when this treatment started and when did it end.

Since we are registered with a GP being long term in the UK, what should I fill for this?

The spouse goes to the GP for normal stuff that people go for time to time.

So I put "Yes" to the question about receiving treatmeny and "No" for being asked to pay. For the start I put the start date of the registration with the GP and end date as "Still Receiving this Treatment" to explain that we are still registered with the GP.

1. Is that alright or do I need a Cover Letter to expalin all that? Or are they asking us to list every visit to the GP (which I have no idea how to find out)?
2. There is also a qustion to add any more medical treatments the applicant has had. Should I mention all the GPs in different places we have lived and the time we were registered there? I am a bit confused about the intent of these questions.

The intent is to find out if the applicant has used free NHS when they were not entitled to. This question is not important. You can either answer NO or list only the last visit.

Hi @ustulation and @ywlgy,

Is it okay to enter the Medical Treatment dates which I am aware of on the application form related to the visit to GP and Hospital, as I don't remember all the dates. And explaining the same on the covering letter.

As I was never been asked to pay for any treatment by GP and Hospital.

Please advice me on this.

Many Thanks

I only put one visit on the form and did not include cover letter. It went well.

Thanks @ywlgy. That was really helpful.

Could you also help me with below queries;
.1. Can we use Online Payslips and Bank Statement and take the print out and upload the same as part of the application as most of the bills, statements and payslips are paperless this days?

.2. My wife visa expiry is 5th Feb 2022, So my understanding is we need to submit the online application before this date (5th -Feb -2022), and uploading of document and Biometric appointment can be booked after this date? correct me if my understanding is wrong ? or the biometric has to be done before 5th Feb.

.3. I have already added some 8 Medical Treatment dates on the application form, which I remember. So would that be okay to keep them on the form or should I just only mention the last visit to GP or Hospital ?

Please advice me on this.

Many Thanks

Do not hijack other's posts!

1. Electronic versions are ok.
2. Submit application before expiry. The rest can wait.
3. You may keep those.
