Period COVID 19 closed Burgh Quay Immigration Office

Post by marinasoares » Fri Sep 16, 2022 10:37 am

Hi there,
I tried applying for a Long Term Residency but it was denied due to the period Burgh Quay Immigration Office closed back in March until November 2020 because of COVID 19, so I couldn't get my Stamp for a couple of months until the Online process was created, because of that i have a 9-month gap in my stamps, is it possible to get a retroactive stamp for that period?

I already have ALL the documentation needed,
I just need some directions on how to add the information correctly into the form/application explaining the situation, which section of the form should i use? Should i add information about it in my cover letter as well?

Thank you!
Marina

there's an automatic prolonged residence from March 2020 i think till 31st May 2022, so I would assume you're covered by that
https://www.irishimmigration.ie/ministe ... rmissions/
This temporary extension of immigration permissions means that people who held a valid permission to be in the State in March 2020 are legally permitted to remain until 31 May 2022, even if their Irish Residence Permit (IRP) card has expired and they are awaiting a new one.
@mentalmind is a good source of info on these I'd say
but from what you're saying, you should be fine in terms of legality of stay, if you had a legal right to be in the country (as well as work permission and all, since I assume youre on Stamp 1) in March
it's not a gap as you were under temp arrangements; if you can mention it in cover letter that you had a valid permission from March and were covered with temp extension, I'd say it should be fine
they know the rules

My IRP was due to expire on 10 May 2021, but it got auto extended by INIS and Garda Stations were closed so I couldn't get the traditional extension till 09.2021 and I had to rely on auto extension for 4 months

Here is how I filled the table:

10.05.2020 - 10.05.2021 (write the passport page number your stamp has)
10.5.2021 - 10.05.2022 (N/A as page number)

there is a blank page that you can write down your excuses or give more information. To that page I wrote: Between the dates 10.05.2021 - 09.2021 I wasn't able to renew my IRP because Garda station was closed, but INIS auto extended of residence permits under same condition. During this time I didn't break any immigration laws and stayed with same employer.

So if your IRP expiry was due at 10.06.2020 you can just put 10.06.2020 - 10.06.2021 as INIS auto extended this with same conditions.

By this explanation I got no questions asked and got my LTR.

All auto-extended permissions should be filled by extending the old permission expiry date up till the date of the new permission start date. You are also advised to add a note for the auto extended period.)

E.g. if your permissions are:
1 June 2019 - 1 June 2020
15 May 2021 - 15 May 2022

You should fill your form with:
1 June 2019 - 14 May 2021 (including auto-extended period from 2 June 2020 to 14 May 2021)
15 May 2021 - 15 May 2022
