I would like to know is appellant is allowed to work while he/she has started Judicial Process or is there any way we can get permission from court to give us right to work until there is decision on Judicial review.
I have submitted my PAP and there was no reply from UKBA so I went ahead got my legal-aid application approved and submitted my case in the court with the grounds on appeal. I was waiting to hear from court on my previous appeal and court made decision on 8 Jan 2014 court said both parties where notified via post but I never received any letter from the court and by the time I found out about this it was past 28 days.
I made new application asap and submitted in priority service and I reject my application while giving me full point in all areas but denied based on the point that I Overstayed but in real I never received any post court about my case been dismissed - from the day I found my appeal was rejected I made a new application on two weeks time but there are still considering me an over stayer.
Now my solicitors say its can take up 10 to 12 week from the time I submitted my ground of appeal to get the decision in mean time I not allowed to work but it says no where in the law the I am not allowed to work and some says I can get some permission from court to work as this can take two to three months.
Can please any one put more light on whether I am allowed to work while JR is in process or can I get permission to work from court until the decision is made on my JR application.
