Permit to stay

Hi there, I have some questions about my status and would like to know if anyone can give me some advices. I am a HKSAR passport holder and I travel with my wife and daughter from Portugal to UK five years ago (they both hold valid Portugal passports). Once we entered Uk, we found a school for my daughter to study and now already 5 years. My stamp on the HKSAR passport already expired a long time. Since me and my wife do not make any approach to the Home Office for any resident permit. I would like to know is it now I become an illegal immigrant ? Is there any way to rectify this ? Can I still apply for EEA family permit ? For the last five years, I did not working since I do not have NI and now my daughter will enter colleges soon so I would like to know how I can start working. Hope some experts will give me some answers.. thanks a millions!!!!!

You do not need an EEA family permit all you need is just get EEA2 form fill it up and send it to UKBA and they will issue you acknowledgement letter which will help you to make NI number and get a job.
But before that make sure that your wife is a qualified person.
Is she working or studying?

Thanks for your reply. Currently, only my wife is working as part-time. She already got NI but she only work in a takeaway shop part time with 90 pounds per wk. So is it OK to prove we are financially self-supported ?We did not claim any benefit from Government although she is entitled to.

Thats good that your wife is exercising her treaty rights now all you need is fill up EEA 2 form and prove relationship with your wife and and proof that she is exercising her EU treaty rights in UK and send application to UKBA.

Sorry, there is one more thing to ask. Since my wife only got so little income per week, is it Ok for our application. The UK Border have any guidance regarding whether income is self-sufficient or not ? I tried to call some so call immigration agency and they said I need to pay more than thousand pounds for processing, is it true or I can send out the application by myself ? Thanks for your advice...

you do not need to pay a single cent to anyone just fill up an application form and send it to UKBA and send the required documents and there is no application fee for EEA2.
