Please advice - WP - change of employer

Hello,

I am on a WP (IT) and working for an Indian company. I have got a new job. The new employer has processed my WP. (Just got approved).

My wife is on dependent visa.

Both of us have not applied for new FLR(IED) as the current LTR is still valid till feb 2006.

My new job is starting from december. I have to go to India in 2-3 weeks to resign.

1. Can I legally go and come back on current LTR? My previous employer is about to send 'End of employment' form to home office.

2. Can my wife stay here and continue her job?

Kindly can you advise how to go about this?

IMHO this should be OK; however, to avoid unncessary stress you can get LTR stamped in your passport at a PEO - cost of £500...just book an appoitment and turn up with ppt, WP document and your payment

Since the HO will be intimated about the end of your employment, your current LTR will eventually be invalidated. You and your new employer should consider sending your passport and that of your spouse for FLR or use the premuim service before travelling to India.

current LTR cannot be invalidated as you have 6 months allowance to get new FLR-IED. but you must have a work permit approved


What sort of employer is that who senmds 'end of employment' forms to HO? :oops:

mwazir is right. The LTR will be invalid the first time the issue comes up, which is when you arrive at Heathrow and they ask you "are you still working for the same employer?" You cannot legally reenter the UK on the old LTR if the job has ended, even if you are getting or have gotten a new work permit. When you arrive, they will ask and they will likely refuse entry if you tell the truth. If you lie, they will let you in but then you could have big problems later on.

It's much better to get it sorted out at the PEO before you leave.

What employer informs the Home Office? Well for starters, it could be one who is simply complying with the law. In new2board's case, he resigned and it's probably known to the old employer that he would be covered by a new work permit. On the other hand, there are many Indian IT companies that would do it out of spite. These are the same companies that refuse to provide letters when the employee qualifies for ILR.

I know a lot of employers dont bother to report end of employment back to the HO, but theoratically all of them are supposed to report. A few years back when I first came to the UK, I was even told that companies that dont report when the employment ends, find it more difficult to process work permits for new staff.
