I first came to UK in July 2001 which is just over 5 years ago.  I got my indefinite LTR in May 2003 because of marriage to a British citizen.
According to the immigration rules, I fall in the 5 yrs rule as well as the 3 yrs rule.
My problem now is that I'm going through a divorce with my husband and it's not final yet.  I have got a NI number but I have not contribute anything towards it because I've always been a housewife.  My concerns are:
1.  Will it be better off if I apply as the spouse of a British citizen under the condition that my man still wants to help me with providing all the doc?
2.  If I apply on my own behalf, will Home Office dismiss or make my case more difficult as I have not contribute to NI or tax in the past at all?
3.  If I do apply on my own behalf,
1)am I a Ms rather than Mrs as I have not changed my surname at all? 
2)shall I tick the box MARRIED, DIVORCED or LEGALLY SEPARATED?
3)do I fill in DETAILS OF YOUR HOUSBAND or IF YOU WERE PREVIOUSLY MARRIED?
