Please advice Not sure if it is worth applying for BC

Post by rainbowcloud » Sat Nov 24, 2018 9:24 pm

I have been in the Uk since 2004. Overstayed my visa for 4 years. Left in 2008 and returned in 2008 via European route after marrying EEA natinal. Received my PR card in 2014. Not married to EEA nationals any longer. He left the country now. So 10 years in relation to good character were up this year. Meet all the rest of the requirements. So my questions are
1 is there any chance of me getting a BC?
2 do I need to say I overstayed in 2004? When I applied for family permit in 2008 I declared it. But never mentioned it again in further 2 applications that I submitted to HO whilst in the UK.
Thanks for your help in advance

You might need to mention it.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

Once you're issued with a PR card, you are no longer dependent on your EEA sponsor for immigration purposes. So the fact that you are no longer together is irrelevant, you qualify to stay in your own merit.
As far as declaring your overstay period goes, it's better to be upfront about it. They can always find out if there are any inconsistencies in your story and they may refuse your otherwise perfectly good application and BAN you from reapplying for a number of years for failing to disclose it. Being honest is best here.
