hi all,

i entered uk on 3sept 2004 on student visa until sept 2008 doing my diploma and degree

then sept 2008 to 2010 i was on PSW(post study work visa)

from sept 2010 to sept 2015 (currently i m on a tier 2 general visa)

what would you advise for me to apply for a 10year long residency visa (which i completed in sept 2014) or wait until sept 2015 and claim my indefinite leave to remain on my 5yrs of tier 2 ?

my only worry is that are there any changes in rules coming up? as in 10 yr long residency is going to be extended for 14yrs?
or tier 2 candidate will no longer be able to claim ILR (thats all what i hear)

thanks

SOHAIL

I understand that the 14 yrs rule has been extended to 20 yrs and it's mainly for overstayers but the 10 yrs rule stays the same and it's unlikely to change (not been touched for at least the last 2 years).

You may request your Subject Access Request (SAR) from HO to check if everything is okay for the 10 yrs you have been living lawfully in the UK.

If you don't have any travelling plan for the next 6 months, you can apply for ILR (LR) or wait till August and apply for ILR via 5 years route as you're able to use the same day service. Also, the new salary requirements of £35K does not kick off until 6 April 2016.
