please give me advice

Post by Punjab » Tue May 31, 2011 2:30 pm

Could you please advice me regarding EEA3 and EEA4.

My wife is a Hungarian national and we are married since Dec 2006.

She came to the UK in December 2006 and she got a job on 15/1/07 and then WRS on 22/03/07.

She will be in the UK for 5 years in December 2011.

Could she apply for her EEA3? Is she eligible?

She was out of work for 1-2 months but she was self sufficient. we didn't know about any insurance. Will this effect her application even if she had WRS before she was out of work for 2 months?

Could I also apply for my EEA 4 along with her application as I will be married toher for 5 years?

Please advice me?

Many Thanks

In order to apply for permanent residence it is not enough to reside in the UK. She has to exercise the Treaty rights - to work, to be a student or to be self-sufficient. She looks all right since 22/03/2007 and so do you.

Was she registered with the WRS without interruption for a full 12 months?

Dear All,

Many thanks for the replies.

My wife came top the UK in Dec 16th 2006

She got work in Jan 2007 and she applied WRS

She left the job in Jan 2008 as we have to relocate to England

SO she did full 12 months employement having WRS

She was not working for 1 or 2 months as we were finiding a job during this time

She got a work like sales which is like self employment and she paid her tax

and she got another full time work on 22/3/7 which she is doing till today i.e 1/6/11.

So could you please suggest me if she can apply her PR even she didn't have the insurance for 1-2 months when she was searching work?

Also I got my EE2 or Residency valid from 24/11/08-Nov 2013.

Can I also apply for my PR along with her this December 2011 or Jan 2012?

Please advice me?

Many Thanks

Like in my previous thread I mentioned about my wife that she was searching work for 1-2 months. and she hadn't have comprehensive insurance BUT she did full 12 months work before she left the job and searched another one.

Is she still eligible for PR as she will be in this country for 5 years in Dec 2011?

Many Thanks

In all seriousness, please! Can you just calm down and also read the T&Cs, in particular point 6.

What misery? A jobseeker is still considered a worker for at least six months of unemployment and as such covered by the NHS. Send off your application already and stop worrying about non-issues.

My wife and me came to the uk on 16th dec 2006 and got married on 19th dec 2006 and she got work in jan 2007 and applied for her WRS.
( So from 16th December 2006- 14th January 2007 we hadno insurance)

She worked from January 2007- January 2008 completing her 12 months under WRS and after that I got EEA2 .

On 13th January 2008 we came to England and she was off work for a 30-45 days. ( So during this time we had no insurance).

We both will be here in the UK for 5 years this December and we wish to apply for eea3+4. my worry is that we didn’t have insurance during the above mentioned times and we have no proof that we were looking for work durning that time periods. So roughly or in a nutshell we didn’t have insurance for 2 and a half months if I calculate all the time periods starting from 2006 till now.

What do you suggest guys? Is it better to waite 3 more months means instead of applying eea3+4 in December 2011 we better apply in March 2011? Or can we apply in December this year and it wont be a problem.

Please advice me. Many thanks in advance.
