Hi there,

This is my situation.

I have a daughter to a guy with whom I live with, but am neither engaged or living together. He is awaiting his HSMP to be granted.

I have a work permit for 39 months and applied to sponsor my daughter but she was refused on the grounds the father had no permanent means of entry and I could not prove I had sole custody. My daughter has a stamp in her passport indicating the failed application.

I have a number of questions.
1. If I travel to the UK with the father (who will travel on a visitor's visa), will my daughter and boyfriend be allowed into the country? Or, is the father better of travelling to the UK by himself with our child, both on visitors visas?

2. If I reapply for her admission, will a sole custody agreement signed by both her father and I, and notorized be sufficient to prove sole custody?

3. If we wait for the father's work permit to be granted, will they grant her EC, even though his permit will be for 12 months and my visa is for 39 months?

4. Is there anyway I can sponsor my partner even though he doesn't fall into the category of spouse, fiance, civil partner or living together for 2 years?

1. Visitors may be allowed to remain the the UK for up to six months only.
