Please Help (stressed)...

Hello guys, thank you in advance to all for helping me. Here is my problem.

I came to UK in 2004, i was on student visa, finished my diploma and masters and went on PSW in 2011. Now my PSW is finishing in 15th November, 2013, and my 10 years finishing in February, 2014. My company applied for sponsorship licence on 2nd of October, 2013 and my visa is going to expire on 15th of November, 2013. So i have no more than 4 weeks left on my hand, and still no sight of company licence (i know it takes time). Now one option i left with is going back on student visa (which is really expensive), I have my wife and 2 year old kid. So the money i need to show for 28 days is not affordable. I can’t even afford to show for myself which is £8000 for 28 days. I am eligible for my indefinite on 17th of February, 2014 (but i can apply for the same before 28 days), so i am eligible for indefinite around 20th January, 2014. So from 15th of November 2013 to 20th January, 2014, i need to fill in this gap to finish my 10 years legally in this country. I worked very hard to reach this point and it suddenly looks all going down and i can’t do anything for that.

Ask the company to request urgent treatment of their application on the basis that they want to sponsor you and your leave is expiring soon. They should enclose a copy of your visa with the request.

Recently the processing time for sponsor licence application seems to have speeded up. See:

Actually you can apply for T2G leave within 28 days of the expiry for your visa. The drawback is that if you do that you will not be able to work after 15 November and if your application is refused for whatever reason there will be no right to appeal.

Max 28 days overstaying will not jeopardise your ILR application on the basis of long residence.

Thank you, so what i need to do? i just need to send an application without sponsorship licence? i will tell my employer to send an email with my visa copy. but this is the first time i am going on work permit thorough company sponsorship. I really don't know what is the procedure and what to do next.

I was kinda gonna be in the situation as you are but my employer got the license just before my visa expiry.

But what I was advised to do was, as told to my employer by UKBA, to make a visa application with a letter from the employer saying that their sponsor license application is in pending with the UKBA, with the Sponsor License Application details.

Please ask your employer to confirm this from UKBA.

wait for the company's sponsor licence to come through. Once they have it they should assign a CoS (Certificate of Sponsorship) to you. With the CoS you can apply for leave to remain.

While waiting go through the Tier 2 policy guidance with particular reference to NQF levels, job SOC codes and minimum salary and check your eligibility:
