Please Help Urgent Help Required

Please help me

I am a Pakistani student resident in U.K , I study in East london uni.

I applied for COA as my girl fried who and i live as umarried couple for last 1 year .we have all proof of address , she is Spanish natioal .

Home Office has not answered yet .

MY VISA is due to expire o 30th of May 2009

What if I dont get passport by then.

Also if i get COA after 30th will i be allowed to marry in U.K without valid visa
as this student visa will be finished by then.

And will i be allowed to make application as I will be illegal the in U.K.

If I push EEA2 application will it be valid.

Finaly if i get my passport back without withdrawig what is quickest route to get married .

Please help .

My course is fiishig as well o 7th JUne 2009

U need two years proof of cohab, one year isn't enough. Even under EEA rules - in the light of the EU's somewhat vague requirements of proof of a 'durable' relationship' the UKBA imposes the UK two year rule.

Plus a CoA isn't a visa - when ur current visa expires u'll have to request ur pasport and leave the UK.

How come ur course finishes AFTER the expiry of ur visa?

Well if you apply for an extension of your student visa before it expires you won't be illegal. You can put a cover note that the passport is at another office and either they can retrieve it to process the application or wait until you get it back.

Unfortunately, a COA does not extend or affect your current leave in any way. As you do not qualify as an unmarried partner, you cannot apply for EEA2 until you marry. It's unlikely that you will be able to marry before your leave expires. If you were applying under the Immigration rules, then you may have problems. However, since you will be applying under European Law, you may be okay.
