****Please help me on what to do after divorce****

Post by haysamito » Thu Jan 21, 2016 12:24 pm

Hi All

I have been married since 2008, I met my wife in 2006 .
i got my visa in 2010 as a family member on an EEA national (i had no visa before this).

in 2015 i applied for another 5 years visa as she was not working continuously for 5 years.
i got the second 5 years visa on March 2015. we got separated and applied for a divorce which was final
in 11 January 2016.

Please help me on this on what is the best option for me now, i have been working continuously since 2010.

Many Thanks in advance.

Investigate if you have acquired PR based on your sponsor's activity 2010 - 2015
- what else was (ex-)wife doing in that period? (eg study, self-employment, self-sufficient??)

If that comes up blank then shoot for RoR; (as you appear to have at least 3 years marriage; 1 year residing as married couple in UK).

Hi

Many Thanks for your reply,

how can i Investigate if i have acquired PR based on your sponsor's activity 2010 - 2015,
She was on and off work during that period, while she wasn't working she didn't study or anything,
she didn't get any benefits either. she had no sick insurance either (basically no proof of her being self sufficient during that time).

Regarding RoR , Will it give me a permanent resident if i will be granted ?
Also just to confirm please, is RoR short for registration certificate or residence card ??

Many Thanks again, Much appreciated.

Just to add a note please, in 2010 i got 5 years family member visa,
in 2015 i applied again and got another 5 years family member visa (will expire in 2020).
but my main question is, because i am now divorced, my current visa will be revoked i think? what do i need
to apply for now considering all the above please?

Many Thanks

Your latest RC will be invalidated due to your divorce because you are no longer the family member of an EEA national.

If your (ex-)wife wasn't working, studying and didn't have CSI to go with self-sufficiency then its unlikely she (& you) have acquired PR yet.

RoR is about retaining rights of residence (in UK) despite or due to divorce.
It can lead to a RC (and eventually PR) for you.

But getting RoR still depends on your sponsor's activity in UK up until your divorce.

See https://www.gov.uk/family-permit/retain ... -residence

Hi,

Firstly, your ex in my own opinion did not have qualified for PR and also what sort of application do you filled to apply for the second RC.

From the look of things there's nothing you can do if the HO aware that you now divorce your RC will be revoke straightaway .

Your next options can not be discuss on forum but you may seek for good advice from any good lawyer
It is really good to help and everyone deserve to be respected in life. Good luck.

Hi noajthan

Many thanks for your reply, much appreciated.

What do you mean please by applying for RoR depends on my sponsor's activity in UK up until your divorce?

She was working continuously for the last 2 years and on and on-off before that,
Will this be enough?

Many Thanks
