Please need help with EEA2

Post by dunga » Mon Apr 21, 2014 4:13 pm

Hi everybody, I hope everybody is ok here. I need some help from you guys. I am in a terrible situation now. Here is my question:
I am married with an EEA person for 18 months now. My RC was issued on april 2013. My EEA wife applied for permanent resident on 5 years basis and was approved 3 months ago. But problem is my relationship with my wife is going very bad at this moment and its very near to divorce stage. Can any one please suggest me what I should do after divorce? Will I be eligible to apply for ROR or I have to leave this country? as she is a permanent resident in uk now so can I expect little help from that? I know to eligible for ROR your marriage have to last for at least 3 years. Can I get any benefits from the permanent residency? Please guys help me. Thank you so much.....

Your EEA national holds PR and not BC.so ROR under EU regulations apply on you.
And as you know the requirements of regulation 10.

It does not matter if your EEA national holds PR or BC, it will make no difference, unfortunately you have not met the requirements. It will be better to try and amend things between you and your wife, you could be left with no choice than to leave the UK.

Hello Guys,
I need very good advice on this one now as im not sure on what to do.
I got Married to a Romanian lady in December 2011 and we lived togeter till june 2012 before she left me and still living and working in another city in the UK as self employed. she changed address of every of her correspondences to her new address since after june 2012. She is not yet a permanent resident.
I got my 5 years resident permit which expires in 2017.
The issue now is this...since we have not been staying together since june 2012, all her correspondences comes to a different address and i cant prove we lived together. She is planning to initiate a divorce after December 2014 which will make it 3 years after the wedding so my worry is how do apply for ROR with her utilities and bank statements having a differnet address from mine.
What can I do and has anyone been in this type of situation before?
