My friend has been recently granted a 12 months leave to remain visa under the 246a rule child right access as stated on the above links. Can you please let me know if it would be OK for him to go back to his country to urgently sort some things out for 3 weeks and he has already booked his ticket. would you please let me know if this is likely to affect his application of ILR in year's time or not?


Is there a maximum time that he is allowed to be out of the country?

By doing so when is it the earlieast that he can apply for his ILR?

The links you have posted indicate that you have already accessed all the possible sources for an answer, which is perhaps why you have received no reply.

Logic suggests that a 3-week absence would not per se disqualify an application for ILR; a frequent theme of questions on this and similar forums is whether spouses on a 2-year visa need a visa to go to whichever country for a holiday. I'm sure no-one has been denied ILR because they went abroad for a few weeks holiday each year, so why would your friend be treated any differently?

You also pose it as a desperately urgent matter. But if he's got to go, he's got to go, and the worst that could happen is that he'll have to apply for a further year's LTR. If gaining ILR in one year is more important to him than his affairs abroad, it's up to him to decide.

He shouldn't forget to take the Life in the UK test before he applies
