pls help!!need

Hello Everybody, Please I need advice and help regarding my issue.I recently got married to my wife, but the issue is that her passport is with the home office, she is eligible for 14 years(residency status) but applying for that will mean she has to wait for couple of months/years.

We have decided we want to aply for spousal visa, what is the best approach for this? Can we apply for spousal visa even though her passport is with the home office? or should she go back to her home country and apply again.

I assume that you are British/have ILR. Spouse visas for overstayers can take a long time, possibly more than 1 year, and have a very small chance of success.

A faster route is for your wife to apply from her home country. The thing to watch out for are the bans for overstayers, which shouldn't apply to spouses of people settled in the UK, but keep an eye on how things pan out on the ground.
