I have to agree with sheraz7 because in my view and based on the op conversation it appear that it is not sure that op will get support from its eu partner. And the official link given by sheraz7 in very first post about ROR is appropriate which do suggests that ror is based on divorce but other experts due to their excessive knowledge did not pick. And I will advise same that if the EU national does not seem supportive then starting divorce for getting ror will be better, the same other guru has already suggested.

But the op will still need proof of the activities of the EEA national for a RoR application so I don't see much advantage here.

There are few difficulties i encountered with Sheraz7 advice, which are best left untouched.

Suffice to say, Retention cannot be dealt with until after divorce.

It would have been open to him to advise OP to file for a divorce, by to say she qualify for retention may not be accurate, as in law , a person in OP's position cannot qualify for retention until there is a divorce.

After Divorce ,then retention may be discussed.

To put it mildly, i will see that contributors suggestion was a bit premature.

Perhaps that may appease us all.

According to the UK legislation, the support of an EEA national is required at Retention or PR stage. Applying for divorce does not exempt one from it.

For getting PR not only the treaty rights but the original passport/id card of EU national need and but in case of ror atleast eu national passport/id does not need. Regarding treaty rights the op can request the caseworker to check eu national's employment/self employment straight from tax department if EU partner nit help. In this case where EU national seems unsupportive then applying divorce leading to ror is better, the same other guru sheraz7 has already mentioned and given the official link in first post. I personally not favor anyone but in this post you all guys repeating same thing in your own best understandable words.
