PLS..NEED HELP...

Hello..all...i am a non EU national ..my wife and my son are EU citizen...I am holding EU-FAM Stamp 4..now the situation is i have a son from my previous relationship(she was non EU)..who is living with us and we have his legal custody..my son was born in Ireland..he is three years old..

now my query is how can i process his naturalisation ....what immigration status he can have..

i would appretiate..if somebody help me with suggestion in this situation....thnx

It is a little tricky one, it depends what was his mother's (your ex) and your status at the time of his birth, if one of yous had work permits for atleast three years at the time of his birth then he is Irish citizen.

You have legal custody/court papers then it means that he is living with you and your name is on his birth cert aswell. You can add him on your passport so he will have same status as you as he is your minor dependent son. If he had spent 5 years on EUFAM with you then you can apply for naturalisation for him and I heard for minors it takes 9 months for application process. All of the above is IMHO.

If the parents of the child (named on birth cert) had permission to remain stamps for a period of three years out of the previous 4, at the time of birth, then the child may be eligible for Irish citizenship by birth. This is not "naturalisation". If either of the parents become naturalised, they can then apply on behalf of the child for naturalisation (this would include adopted parents) if the child is still under 18 at that time.
