Plse help with information

Post by Thandia » Wed Jan 16, 2008 1:03 pm

I'm a social worker currently working with refugees & asylum seekers & am writing to request for some advice. Yes I have my client's permission to post her story here as she is @ her wits end & her solicitor seems pretty pointless.

My client is a failed asylum seeker from Zimbabwe. A month ago, she received documents from her sister issued by the police force of that country where she has been charged with inciting violence through political gatherings. The truth is my client was already in the UK on the alleged dates & the warrant also mentions that my client fled to the UK to escape apprehension by the police.

1. As my client is a failed asylum seeker, what would be the best way forward?

2. Her solicitor is no help & seems to provide misleading information eg. when she went for her appeal, her solicitor told her that it was unnecessary to include documentary evidence proving her case in advance to the AIT & instead she could just take this with her on the day. The judge dismissed her evidence as inadmissible as it wasn't previously mentioned.

3. My client has a son aged 11 who arrived here last week through South Africa (her sister paid a South African to bring him in on an SA passport as the entire family has left Zimbabwe & she can no longer afford to look after the boy). Should she take him to Croydon & make a fresh application with these new documents & her son included?

4. Clearly with the documents she holds claiming she fled the country to escape apprehension & that she is a politically active in Zimbabwe & inciting violence while she is out of the country means the situation for her would be disastrous if she was returned?

5. Would it be any help if her profession is on the shortage occupations list on the Home Office website? She is a qualified social worker who is registered with the General Social Care Council here in the UK.

I am asking for help online as she currently cannot afford to pay the consult fees for a new solicitor & is at the end of her tether such that I fear for her mental wellbeing. She lives about 3 hours out of London (nearest IAS office) & so far has not been able to get an appointment with the IAS for a free assessment.

Any help or advice would be greatly appreciated. Thank you.
