Plz advice what should I do?

Post by server » Sat Jan 18, 2014 12:13 am

I am non eea national divorcee. I have completed three years on my Residence Card. My marriage has lasted almost five years & we have spent three years under one roof in UK. My Ex is willing to provide me her Pay Slips & Bank statements. My immigration solicitor advised me that he'll just send a letter to home office saying i am divorcee now. He says there is no need to apply for another residence card (Retain right of residence) as i can continue with the same and directly apply for Permanent Residence after two years. I would like to know if that is the correct thing to do.

I'll be thankful for your replies.

i am not a senior Member, but from experience you could carry on with the same visa if you have no plan of travelling outside uk! however for peace of mind it is always better to apply for your retention of right just in case you find yourself in a situation where you may need to give evidence in respect of your visa.
GOD BLESS!!!

You might prefer to apply for RoR now (although not required) as you never know what the future holds. Maybe it would be difficult to obtain your ex co-operation in 2 years time. In any case, I recommend you organise the relevant required evidence needed for PR now (i.e. evidence of her treaty rights during your residence in the UK).
