I had Tier 4 visa between August 2010 & January 2012. After I received master's degree, I got a Tier 1 (Post-Study Work) Visa on January 2012 and started to work on May 2012. Then, I switched my Post-Study Work Visa to Tier 2 (General) on November 2013. The company has decided to outsource the department that I am working at. That's why I have been seeking internal opportunities and I have been accepted for a suitable job.
My SOC code is 3541. I told the company a change of employment is not required if I am remaining with them and change my job to a different job within the same SOC code. They checked the example job descriptions and confirmed I could remain with the same SOC code. However, they wanted to double-check with the expert advisors. The experts advice is that I have been sponsored in is an NQF Level 4 SOC code. As I applied to switch into Tier 2 (General) after June 2012, I should have been sponsored in one of the NQF Level 6 SOC codes. Technically, my application should have been refused.
May I ask if there is any chance you could recommend me what I am supposed to do about this? Do you think Home Office granted me a Tier 2 (General) Visa by mistake?
