ILR or not?

Hello.everyone.i am new here.i have a question to ask you guys.hope I can get some advice.thank you.

Basically.this is my status.just wonder if I am eligible to apply for the ILR.

2004-4-24 entry in UK as student visa till 2011-8-25.

2011-8-30 psw till 2013-8-30.

Then apply for the tier1 (entrepreneur)on 2013-8-25

Just received the interview letter which let me to attend the interview on 2014-3-18.

Now I just want to know if the HO refuse my application before 2014-4-24.for example on 2014-3-24.base on the 28 days rule.am I still eligible to apply the ILR on 2014-4-28? Any advice please.

Noted! I wasn't aware since I don't have that much dosh lying about to be an entrepreneur ;-)

you can appy to vary your application to set(lr) 28 days before you qualify under 10 long residence

I just worry if they refuse my Tier1 entrepreneur application before 2014-3-28 which is the date I can apply for the ILR base on the 28 days rule.any chance I still qualify for the ILR

My question is for example the HO refuse my application by 2014-3-26.but I can apply for the ILR 28 days before my 10 years complete which is 2014-3-28.the gap between 26th and 28th.does it count to be legal stay?I hear someone said I have 28 days legal stay even they refuse my application. MY question is in this case can I apply for the ILR on 2014-3-28?my 10 years complete date is 2014-4-24.

Hello. everyone here.i have a urgent question to ask.
I came here as student in 24/04/2004,then I renewed my student visa till 01/08/2011,after that I applied for PSW visa which was expired 01/08/2013,before my visa expired I applied the tier1E.till 14 March 2014, I have the interview with HO.

the problem is if they refuse my application by 20/03/2014,which is 35days before I complete my 10 years ILR.i become overstay.just want to know during my overstay time I apply my ILR( within 28days),just say on 28/03/2014 which 28 days before I qualify 10 years ILR.is it the overstay break will be disregarded because I I apply it in 28 days?is it possible I get my ILR?

Thanks for your reply.i just want to know if no appeal given in my case.during the time I overstay(in 28days)can I apply for my 10 years ILR 28 daysbefore my 10 years complete?The home office document shows if the overstayer apply with 28days.the break will be disregarded.is it applied in my case?

I came to England since 23/Apr/2004.then I have renewed my visa in time(3 times student and PSW visa) till 2013...25/08/2013 my PSW visa expired, then I made an out of time application for Tier1 (psw - entrepreneur) visa on 27/08/2013.but today I received the refusal letter(refuse date 02/04/2014) with no appeal right given.i have to leave UK as soon as possible.

But can I apply for my 10 years long residence ILR straight away? Because my 10 years completion will be on 23/Apr/2014.base on the 28 days rule.i can apply for it on 27th/Mar/2014(few days ago)...

Any advice please.very very urgent now.thank you

Why didn't you apply in-time?

I think it would be difficult if you made an out of time application and have now overstayed for longer than 28 days.

Well u can apply for ILR but you have to give strong reason of applying out of time and then it's only in the hands of the case worker but it's better you consult any solicitor as they can guide you better. By the way what were you rejections reason and if you don't mind tells us why you couldn't apply in time. If you think your refusal reasons are baseless then you can try to FTT they may accept your appeal. But advice is consult any good solicitor

Looking at your post in this topic your posts are contradictory to other posts u made. In one post you said u applied in time and now you are saying u have made out of time application. Can you make the correct statement so others can give u some proper advice

this guy was asking a simple question that his visa was refused on 02/04/2014 with no appeal right,can he apply for ILR within 28 days of VISA refusal ? but I surprised to see that no one answer his question and making irrelevant question.

as far I know he can.please correct if I am wrong

No, because his leave had expired on 25/08/2013. After that, he made an out-of-time application, which had been refused 20/04/2014.

Unfortunately, he has been an overstayer since 25/08/2013. That's over 28 days.

Contrary to what you wrongly asserted, it appears that Vinny had already replied to this person query.

I also believe that person would have taken Vinny's advice on board 7 months ago.

Not sure your inaccurate post will assist him 7 months down the line.
