Elderly mother - Ascendants Dependency confusion

Post by DingDong » Sat Mar 15, 2014 6:33 pm

Hello All,

I am a Naturalized Irish citizen & would like to use the EU directive 2004-38 route to get my mother accompanied with me.However I have the following scenario uncleared and therefore posting this to get some thoughts.

1) Does my elderly mother fall's under Direct dependent & Automatically qualifies for EEA resident permit (if I move to other Union country)

2) Or do I have to prove that my mother is dependent on me (and go through collecting paper work for proving the dependency)

I have found a mix set of opinion across the board.

Some suggest Parents do automatically qualifies as Dependents and some say's one need to prove the dependency.

The below document clearly say's that Parents falls under Direct Family member's & does not fall under the category 'Other family members'

http://ec.europa.eu/justice/policies/ci ... vement.pdf

So I need to find what is the right information & does accompanying a Parent consist of same SIMPLE process as getting a spouse or a child to join you in any EU country.

Any thought's I will highly appreciate & many thanks to all in advance.

Although she is a direct family member, you will still need to prove dependency.
