Demonstrated English Language Qualification

Post by v.nikzad » Wed Mar 19, 2014 10:38 am

Hi All,

I will be applying for my naturalization soon.
I have already demonstrated English language qualification (@Level B1 as required) in one of my visas (Tier 2 - 3 years ago).
The qualification was IELTS and was within its validity period at the time I applied.
It is now expired.
I found a term in one of the UKBA documents mentioning that if I demonstrated my English qualification in past visas, I won't need to do that again.
I am not able to find that document in the new immigration website anymore.

Anyone knows if this condition is still applicable?

Thanks a lot in advance,

Regards,
Vahraz

Just communicated this to UKBA and got the following answer:

Original Inquiry from me:
Dear Sir / Madam,

I do have an inquiry about Citizenship Application and I was wondering if you could kindly help me out.
I will be eligible to apply for British Citizenship in April 2014 (am currently under ILR for 1 year). About the English Language Qualification, I have already demonstrated the required B1 Level, in my Tier-2 visa I obtained about 3 years ago. At the time I applied for the Tier 2 Visa, my English qualification was within its 2-year validity period. However, it is now expired. My English qualification is IELTS and I could meet level B2 with it. I passed it about 4 years ago while I was living in UK.
I wanted to know whether I could present my IELTS qualification referring to the Tier 2 visa for which I used it. Is there any explanations / documentation required that I should present with my Citizenship application?

Your kind attention and response would be highly appreciated.
Thanks a lot in advance,

Best Regards,
Vahraz Nikzad

UKBA Answer:
Dear Vahraz,

Thank you for your email.

Qualifications covering speaking and listening at B1 or above from the Secure English Language Test (SELT) list in the Immigration Rules, Appendix O. The SELT list is available at:

https://www.gov.uk/government/uploads/s ... -tests.pdf

Applicants who already have an English language qualification at B1 level or above will not be required to take another one. For example, someone who demonstrated a knowledge of English equivalent to B1 level when applying for entry clearance will not be required to take a further test in order to qualify settlement.

When you submit your application I would advise you to submit the expired test certificate or results page and explain in the further information section of the form that you demonstrated knowledge of English at B1 when you applied for your T2 visa.

Kind Regards

Expiry dates do not apply for naturalisation applications.

3. What if your website says my qualification expires after 2 years?
The expiry dates on the SELT list in Appendix O, do not apply to citizenship applications.
For Settlement applications, we will accept Level B1 qualification on the SELT list or an
ESOL qualification on the OFQUAL register at Entry level 3 that has passed the expiry
date, if:
