british naturalization

Post by passysymbol » Tue Apr 15, 2014 7:40 pm

Dear all,
i have one question just to know if i can apply for British naturalization and what date to put on the form asking for when i did receive permanent residence.
my case.
i am non EEA family member, married to EU citizen.
i am in the UK since February 2008, i came here with 6 months visa after marriage.
i receive 5 years residency stamp in august 2009
and this year i receive a permanent residence stamp in march 2014
i have passed life in UK and the B1 English test.
Can i apply now or i have to wait 12 months after receiving a permanent residency stamp ?
Thanks

You can write February 2008 as you were entered in uk and as your spouse is not British citizen so I think you have to wait one year before applying for naturalisation

Sorry i don't understand this.
i have been living in the UK since February 2008 this is more than 6 years, and it also said that after 5 years i am automatically permanent resident. So i am permanent resident since February 2013 and i believe the Permanent resident stamp i have in my passport since march 2014 is just a confirmation.
Please can you explain ?

Technically speaking if you have got the PR stamp then u need to wait 12 months after that PR stamp.

If you didn't apply PR you could have applied for "naturalisation" via 5 years treaty tights exercised by EU national plus 12 months residence. = 6 years total.

I applied myself for naturalisation on these basis without paying for PR stamp as you don't need it but if you obtain it then you need to wait 12 months from the issue date of that stamp before applying.

*don't hold me to this info but that's what I was advised my senior members here and they know their stuff.
In any moment of decision, the best thing you can do is the right thing, the next best thing is the wrong thing, and the worst thing you can do is nothing.

Dear all
Q5 is exactly my situation, as it say i can apply but i cant use the PR because i only had the PR since 1 month, but i have been to the UK for more than 6 years. In that case what will be my answer to this question of AN form ?

1.3 Please say when you were given indefinite leave to enter/remain in the UK (not necessary if you are a Commonwealth
citizen with right of abode in the United Kingdom). If you are an EEA
national, a Swiss national or a family member of an EEA or Swiss
national you should read pages 9-10 of the Booklet AN.

Dear all, i would really appreciate if someone can explain when best to apply for naturalisation. I came in to the UK with a student visa in Sept 5,2008,I was granted PSW in Jan 2010 then changed my visa to spousal visa JuLY 21,2011. I was granted ILR June 24,2013.
i.e Student Visa = Sept 5,2008
PSW = Jan 10,2010
Spousal Visa = JuLY,21,2011
ILR = June 24,2013
So my question now is when am i qualified to apply for naturalisation? I am married to British citizen by the way. Thank you.

If you don't want to wait 1 year, either leave blank (as you were never given ILR) or put the 5th year date. You will need to fill in section 2.4-2.6 and provide the 5 years evidence you provided for the EEA4 application. Its a different team dealing with naturalisation and they will need to examine the evidence again.

Hi all,

The FAQ Q5 is my situation.

I came to UK in April 2006 as a student,

In Sep 2008 I applied for family member residence card via EEA2 and received it in March 2009,

Yesterday I received my Permanent Residence (via EEA4).

Overall it is just over 8 years me being in UK. My question is do I have to wait for 12 more months in order to apply for citizenship :?:

Thanks!
