Same question in my mind.
I submitted only degree certificate.
My solicitor said to send only certificate, not transcript.
First I attached it with my application but he removed and said there is no need of it.

I rang to Home Office this morning. They said "If case worker need some more information they send you a letter" However I saw so many cases they refuse without requesting any further information. :(

If any document they required in application form and not provided then they can refuse or demand.
On application form, they clearly asked for degree certificate.
So don't get confuse.
Did they really refused applications for not submitting transcript and only certificate.???

because 18-21st was holidays, where as 22nd was ony a day before, if they have approved any on 22nd it takes 3-5 working days to get to applicant which could be anytime tmrw or day after.

Hi Friends,

Just let you know guys regarding 6th April changes for dependents of 10 years ILR. One of my friends got ILR on 10 years basis he was on Tier 1 General and his wife was dependent as Tier 1 general entered in the UK before 9th July 2012. He applied FLR M after 6th April 2014 at PEO Croydon and got 2 years visa after getting BRB I think after one week he applied SET M at PEO Croydon and got ILR.

Thanks

Wow thats great news. Above experience might clear most confusions.
I believe the same, Transitional arrangements still reserved for Pre July 2012 dependants. Just waiting for my ILR and few more experiences.

Cheers for sharing. 8)

Hi Kashif,
Well done. Thanks for the post, that is great news for a lot of people effected by these new rules changes.
We have extensively discussed this issue in the forum in the last couple of weeks, but every one was waiting for these kind of test cases to come up and clarify the rules.
Once again many thanks for sharing this great news.
Kind regards

Hi Folks,

This forum has been of great help to me over the years, and I do need a suggestion as to make a decision.

I came to UK on 10th September 2004 and have been living here legally under different visa categories (with 352 days of absence till now). I will be completing 10 years in September 2014. Also, I will be completing 5 years under Tier 1 on November 20th 2014.

Can you please suggestion whether it is advisable to apply for ILR under 10 years long residence or based on Tier 1?

If applying via Long Residency, when can I apply? I mean I complete 10 years on 10th September 2014, so can I apply in August or I have to wait until 10th September 2014?

Many thanks

for ILR you can apply anytime after 11th August, however it will be postal application only and as of now it takes them atleast 3 months to make decision so realisitcally you will get your decisions around 11th November.

however if you want to apply on 5 yrs Tier 1 i guess you can apply in person - pay the premium and get to know same day(in most cases). also this application too you can submit 1 month before - ie anytime from 21st October.

hope this is clear - if you want imidiate answer with extra money go on 5 yrs basis, or save little money and go on 10 yrs basis, however the wait for 3 - 6 months is a killer - ask us who are going thru it, either way you can always submit a note in covering letter for the other option ie if you apply for 10 yr basis - put a note you finish 5 yrs in November too. or otherway.

Hi Hardikjshah83,

Thank you for the reply.

I do prefer going for the 10-year residency because I do not have to worry about the requirements for earnings if I am applying via the Tier 1 route. This is because I might have to find a second job in case to fill the gap of the shortage of earnings requirements.

Another query though. During the period of 2006, I was without a visa for 39 days. I mean my working holiday visa expired in July 2006 and went back to India.

I then applied for a student visa in India which was refused. Applied for a fresh one immediately and was successful. So returned to UK on a student visa after a gap of 39 days. Will that cause a break in my long-term residency of 10 years?
