Resident Labour Market Test Exemptions - Confusion

Hi,

My brother is currently on PSW Visa and has been working as an Oracle Database Administrator for the last 10 months. He wants his company to sponsor Tier-2 general Visa. We have looked at the exemptions for Resident Labour Market Test. His job category falls under NQF Level 4. Can his company sponsor his tier-2 visa without a resident labour market test?
