Switching to Tier 2 (General) from PSW after expiration date

I have been in the UK working with my Tier 1 PSW, and my employer was slow in applying for their certificate. It turns out they were missing a document that they need to submit, which they are working on now. However, it is getting VERY close to my PSW permit expiration date (4 October), and I am afraid they will not have the certificate by that date for me to send in my visa application. I noticed on the application that there is space for extenuating circumstances for applying after your previous permit has expired - does anyone know if this counts? I really do not want to leave the country to apply for the visa...HELP!
