Calculation of 2 years of stay in UK

Post by sresree140 » Mon Jul 14, 2014 11:16 am

Hello,

I am on dependent visa as a spouse of UK citizen. My application for dependent visa was made before July 9 2012, hence the old rule applies. My visa details are as below.

Valid from date : 17/09/2012
Entered UK : 27/10/2012
Valid to date : 17/12/2014

As I understand, I need to apply for ILR 28 days before the visa expires
To-be Application Date : 19/11/2014.

I will be completing 2 years stay in UK on 27/10/2014 as per my entry date. But we have cohabitation document (tenancy Agreement in which both mine and my partner have been added) from 08/12/2012 only. From my entry to UK till 08/12/2012 we were staying separately since I got a job which was away from my husband's house and we took a new house shifted together near by work place from 08/12/2012.

If I apply on 19/11/2014, 2 year cohabitation on date of application fall short by 19 days. But on 27/12/2014 date on which my visa expires, we have complete 2 years cohabitation proof.

Does this affect my eligibility to ILR this time? How is the 2 year period calculated?

Please advise.

Thanks
sresree

From 28 days before 27/10/2014, those documents should be ok, B1 English and LIUK required.
