Successful SET(O) Tier 1 - PEO Cardiff 16/08/2014

Post by sab516 » Sat Aug 16, 2014 3:00 pm

Many thanks to all gurus, moderators, senior member and other members for keeping an informative forum alive with comments, suggestions, experiences.
I had a strange experience when the case entry operator returned my cover letter saying this is not required. When I suggested that case worker may need these to understand more about my situation and points claiming criteria , she said that they will have all these from my previous Home office application records!! She didn't even think that applicants earnings situations can be different in a current application as compared to a previous one. Ultimately, I had to go with what she said and I removed my nicely drafted cover letter from the submission pack.

The biggest surprise was when I realised that I had not submitted an excel format detailing my personal absences of 140 days.coz this was stapled with my cover letter, which was returned as the first thing. The case worker never demanded these when he worked through my case. Second strange thing for me, considering people have been posting confusions and questions on absences less than 180 days.

Total time taken from to token issuance to decision was 2.5 hours.

1. Category- Tier 1 general
2. Number of dependents- 0
3. Total cost-£1493.00
4. PEO branch- Cardiff 16 Aug 2014
5. Documents provided:
Mine was a straightforward case. Permanent employment in last 12 months. But had a mix of permanent and contracting( ltd company) work in last 4 years before ILR qualifying period. No evidence of these were demanded.
07/2014 version SET(O)
2 photos ( although one was returned along with returned document pack)
12 months salary slips- signed and stamped by employer
12 months original bank statements
LIUK PASS CERTIFICATE
Print out of UKVI points based calculator- but this was returned at the end of application process
Original bachelor of engineering degree certificate- Indian university, which is recognised on PBS

6. Absences more than 180 days in any of the qualifying years - No, had 140 days absence in last 5 years. All personal.no evidence or detailed absence sheet provided.
7. Any Additional Comments- Although I had carried all my 5 years payslips, all previous P60, previous Home Office letters and itinerary/boarding passes for all absences , none of these were demanded.

I will be happy to answer any questions. Thanks and good luck to all.

Thanks @aravindb4u

@hsr1972- with ref to section 6.2 in set(o) form which asks to details of 5 year absences from UK, stating reason. with personal absences I meant a tabular representation of my day out, day in, passport page number containing the entry/exit stamps, reason for absence. As per settlement requirements we do not need to explicitly detail 5 year absences if it's within 180 days per calendar year. Mine was 140 , well below the limit.all my reasons were Personal-family visit India.
I did not use the official stationery for LIUK.i just read the study materials available on google search, and took many mock tests. There is separate sticky thread for help on LIUK test. That contains all the websites offering free study materials.

@hsr1972. Yes, from my experience evidence of absences will not be required if it's less than 180 days.

@hsr1972 : Although I did not submit a cover letter with my application, I had used the format which was posted by some fellow members. You can find several threads in which people have shared theirs.

Congrats sab516 for your ILR success.

I have an appointment at PEO Cardiff next month. Could you clarify these?
1.I have original payslips, do I need to get stamp & sign on it from employer?
2.Did you submit photocopies of all documents?

Thanks in advance.

Hi all,

Can you please advise what is the answer of

(I entered UK Sept 2006 Student Visa & Tier 1 Granted Sept 2009)

6.1 When did you (the main applicant) first enter the UK? This refers to the date of your first entry into the UK at the beginning of the period of stay on which this application is based.?
7.11 How long have you lived in the UK?

Thanks Again !!

The answer should be based on the date when your Tier 1 visa was granted. i.e SEP 2009. The question has the words this application is based and to me it means use the dates from the visa on which your SET(O) application is based, which is Tier 1 in your case.

If you are applying in Aug 2014, then the answer would be 4 year 11 months. I will not recommend using any references to your student visa days, as it falls outside your qualifying period of SET(O). I feel that your application might become unnecessarily complicated if you use references to your 2006 Student visa. Tier 1 since Sep 2009 would be sufficient for ILR through 5 years SET(O) route.

Hi Sab516,

First of all Congrats for your ILR...

I have question for you then on 6.1....As many guru/experts have already answered this question but still have this question in my mind

As my visa stamped on 16th Oct 2009 and i entered in the UK on 25th Oct 2009 then as per your statement below,"the words this application is based" so what would be the date in my case?

I am applying ILR 28 days prior to 16th Oct 2014 so the date would be 16th Oct 2009 as my application is based on Stamping date (16th Oct 2009).

Thanks in advance.

Regards,
Raj

Hi Raj, Thanks, getting an ILR is a relief as you are no more subjected to immigration controls !

The obvious answer to your question on when did you enter UK will be 25 Oct 2009. But your continuous period calculation will start from 16 Oct 2009 ( your visa start date will be the start of ILR period due to the 90 days concession period)
Ref : Page 22 --> https://www.gov.uk/government/uploads/s ... eriods.pdf
"The period between entry clearance being issued and the applicant entering the UK may be
counted toward the qualifying period, as long as it does not exceed 90 days. This can occur
if the applicant is delayed travelling to the UK"

I would recommend that you explain this in the first paragraph of your cover letter, quoting exact reference to this section.

Does it effect my application if I enter 4 year 11 month?

I entered 4 yr 11 months in my application, and wasn't questioned by case worker.
It will not affect your application provided you have completed 4 year 11 months and 5+ days, from start of Tier 1 visa (since you were in country applicant)

The 28 days concession period will come into effect - Section 5 5. When to apply --> https://www.gov.uk/government/uploads/s ... _08-14.pdf

You would need only these 2 print outs for the PEO:
1. The email from UKVI (DoNotReply@homeoffice.gov.uk) with the subject "Appointment booked"
2. Payment sheet
