Quick question regarding my wife flr(m) english language requirements.

I know she need to pass A1 from any of the approved language centre as mention in guidence.

But i am just wondering if she give B1 instead (which she need for ILR) after 5 years wont that will meet the requirment for A1 now and B1 after 5 years at the time of ILR.

Please advice any help will be highly appreciated.

Regards
Hi rehan01,
That should be perfectly alright, but please make sure that the institute is fully registered and legitimate before you submit the documents. My wife did a B1 from Trinity College and she applied her FLR(M) with that, and than she applied her SET(M) with the same, and there were no issues. So I would say should be alright.
Kind regards
Shahjee

On the FLR(M) form guidance notes (Page 2), it is mentioned as -

You must not use this form to make an application for an extension of stay in the following
categories:
• As the partner of a serving member of HM Armed Forces under Appendix Armed Forces of the
Immigration Rules. You must complete form FLR(AF).
• On the 10 year Partner route under Appendix FM of the Immigration Rules. You must complete
form FLR(FP).
• As the partner of a person granted indefinite leave to remain in a work route, if you are currently in the UK as their dependant.

So according to the second point, the dependant of 10 year ILR or SET(LR) applicants cannot apply using FLR(M) but FLR(FP) ? Please clarify guys.

Thanks
Hi die_hard,
Very interesting for you to point this out, frankly I never paid any attention to this page. Doesn't make a lot of sense though because if you look at the section 1 which says
1. For which applications must you use form FLR(M)?
Form FLR(M) must be used if you are applying for an extension of stay and your partner is:

• present and settled in the UK

So I believe that by virtue of this a dependent of a settled person is already entitled to apply for the FLR(M), hence we ignore the rest. I know doesn't make a lot of sense but there we go another misinformation by the Home Office.
Kind regards
Shahjee

Congratulations rehan01,

You really deserve it as you waited so long (including your waiting time of Entrepreneur visa and its negative decision).

Its fine to use B1 level English for your wife but it must be from following list.

Thanks so much Prem-singh123 and Cool mind. Me and my family are so relieved. The brp was delivered at solicitor's office even though I changed my address 2 weeks ago and no sign of my passport and degree certificate yet.

Shahjee, I'm sorry but I think the wording is perfectly right.
10 year Partner route under Appendix FM of the Immigration Rules is different from applying as a spouse of settled person either by LR or otherwise.
10 years partner route is a discretionary route for partners and parents of a settled person who mostly are currently illegal or do not meet the financial requirements.
hope this helps

Dear All,
If anyone could give me advice for the questions below, I would be grateful. I am going to apply on Monday.

1. I am going to apply for myself and for my son who is 15 years old as he came with me ten years ago. He had been my dependent for the first 6 years, then he took his own student visa. I know he should apply independently but not as a dependent, so I am preparing his application form too.
Just recently, I found out his passport has expired in May. But his student visa expiry date is in 2016. I soon applied for his renewed passport and we can get it on this Friday. I was wondering if this gap between May and August will be a problem for the 10 years requirement… because the passport needs to cover for the all 10 years stay, doesn't it? Or if his visa covers 10 years, there will be no problem? I have asked a immigration advisor about this and she said 'no problem', but now I can't trust her words for some reasons previously mentioned, so I am asking if anyone know about this to make sure.
If it will be a problem, what kind of document is appropriate to submit? He is 15 years old and doesn't have any public document which has his name on..

2. In previous forum answers, I read that we should photocopy all of the pages of the current passport, but for the old ones only visa page is ok. In my son's case, as the reason above, the current passport will be all blank pages but do I need to photocopy for the all of them?

3. Even though my son is 15 years old and he has no bank account or utility account or anything, should he sign the section 5, page 22?
It's strange because on the section 6, they say parent or legal guardian should sign if applicant is under 18, but for the section 5, there is no mention about this, so I was wondering if someone know about this.

4. When I applied my current Tier 4 student visa, I was living in temporary place and didn't know the next address when the granted letter and BRP would be sent. So I used my friend's address as corresponding address. I could move in to a new place which is my current place, but the granted letter and the BRP arrived the corresponding address and there was no problem.
My question is should we notify this kind of address change when we were waiting the BRP comes? I don't know if BRP hold address information too, but if so, my current address is different from that record, so will it be a problem? Anyway I made a list of my addresses in the last 5 years to put after B14, B15, so is that enough to show my address changes?

5. Does anyone know if it's ok to put my application and my son's application together in one envelope to send? Because he was my dependent for certain period, also I am his parent and signed his form, so I think sending together is more sensible..

If anyone give me prompt answers, I would be appreciate.
Thank you.
