URGENT HELP - BRITISH CITIZENSHIP APPLICATION CLARIFICATION

Hello All,

I am planning to apply for BC next week via NCS. I got ILR over two years ago. I am an IT Consultant and have a Ltd Company.

I currently take a salary of 640.00 as well as Dividend each month. I don't pay PAYE tax and National Insurance because annual salary is within the Personal Tax Allowance - Please Correct me if am wrong. I pay company tax each year and am up to date with it.

My questions are:

Question 1
. Will not paying PAYE tax and NI be an issue?

Question 2. Am I Self employed or Director?

Question 3. Do I need a Self Assessment Statement of Account? Page 8 of Applicants Guide AN document states:

"3.1 – 3.5. If you do not pay income tax through PAYE you must demonstrate that you have discharged your obligations towards the H.M. Revenue & Customs, by attaching a Self Assessment Statement of Account (see page 16)."

Question 3. Are the following documents enough for application?
a. AN application form.
b. Certificare of UK Masters degree
c. Life in UK test certificate
d. Passport
e. ILR card
f. UK Driving Licence (used for Life in UK test)

Question 4. Is any of the following needed or useful with the application?
a. Personal bank statements
b. Ltd Liability Company bank statements
c. Letter from my accountants
d. Payslip and Dividend slips
e. Past p60's

Question 5. Do I need to declare a motoring offence I had in 2006? - Was doing about 45mph in a 30mph road - Have paid fine since and edorsement have now cleared from paper counterpart of my driving licence

I would personally go to a solicitor and ask them to check everything for you.
With regard to bank statements, yes I would send the last six months. You can always send what you think is relevant and would help your case.

Hi! My case was similar to your so let me answer to the best I can.

Question 1 . Will not paying PAYE tax and NI be an issue?

I don't think so, as you pay VAT Quarterly, and yearly Tax.

Question 2. Am I Self employed or Director?

In my case, I was Employed as well as a Director not Self Employed. They mean 2 different things. I assume you are the Director with shares of your company.

Question 3. Do I need a Self Assessment Statement of Account?

I think you need to send the self assessment statement account that you as a director need to fill every year. Ask you accountant for it. Don't forget to send the yearly corporation tax that you pay, plus quarterly VAT receipts.

In my case, as I had not reached 1 year of trading, my accountant wrote a letter with statement of earnings and expected tax return etc. Strangely, the NCS, did not ask for those letters, even when I showed them. She only took my application saying since you received ILR on a 5 year basis, we should not give the case worker unnecessary documents.

It may be that you may only need to send the application forms. If you have paid your taxes, VAT etc on time and properly then you will not have any problem. If you have done anything towards the side of illegal, then I would advise you to get a solicitor and a good one.

Question 3. Are the following documents enough for application?
a. AN application form -- Must
b. Certificare of UK Masters degree -- Must (Original)
c. Life in UK test certificate -- Must (Original)
d. Passport -- Must (Original)
e. ILR card -- Not required as you will give the details of ILR on the application form. Can send a copy? NCS will decide.
f. UK Driving Licence (used for Life in UK test) -- Yes. NCS will make a copy and send.

Question 4. Is any of the following needed or useful with the application?
a. Personal bank statements -- Not necessary.
b. Ltd Liability Company bank statements -- Might (see my case in Q3)
c. Letter from my accountants -- Might (see my case in Q3)
d. Payslip and Dividend slips -- Might (see my case in Q3)
e. Past p60's -- No

Question 5. Do I need to declare a motoring offence I had in 2006? - Was doing about 45mph in a 30mph road - Have paid fine since and edorsement have now cleared from paper counterpart of my driving licence

I don't think so, but you might have to declare it. Best others can advise.
