@ Bill9: This is pretty damn interesting case!!! CONGRATULATIONS :D First of all, I have never heard of anything like applying for PR with less than 5 years of marriage! You can well apply before the expiration of 5 years Resident Permit provided you have been married for 5 years by then. So, I'm a little bit confused! :) My husband confirmed his settlement in UK in early 2010, so theoretically I could have applied MUCH earlier... Did you speak to solicitor before applying? I remember I have been told that I could have applied for ILR after 2 years based on my husband UK settlement, but that would be according to UK Immigration Law, not European (what all of us are using with EEA2 / EE4).
@ Mirth: I know few friends that have applied for PR after 4 years and few months of marriage and qualified for PR, I didnt send my application with a solicitor i sent it by my self. i have spoken with few solocitors in the past and they told me that i cannot apply unsless i have 5 years of mariage from the day i got married.

Hello,

I am a bit confused about the date when my wife (Non-EEA) should apply for PR. Both of us spent more than
5 years in the UK, and I am a EEA national. Is it at most a few days before her current card expires (5 years),
of after 5 years and 1 day? As mentioned just above it does not seem to clear to me. Any idea?

Thanks a lot,

Hi.
I have called Home Office twice regarding "when can one apply for PR". And my understanding was a non-EEA cannot apply for PR before 5 years of the EEA visa expires, unless he/she was in this country who were allowed to work full time. In other words if you were student before being an EEA-Family Member, you cannot apply for PR before the expiry of EEA visa. Although when i called them 4 weeks before my EEA (5years) visa was about to expire, and they said that you can apply 4 weeks before it expires. So you can send your EEA4 application just 4 weeks before your visa expires.
Thanks

Good for you that home Office caseworker was quicker to do what they are paid for the latter not being the case of the kind people volunteering in this forum to help for F.R.E.E , spot the difference yet
GOD BLESS!!!

I applied on Sept 1 and still waiting. When did you ask for your passport back? Did you include a pre paid special envelope? And did they use it to send your passport back?

Just called the HO and was told that a decision was made on my application and docs were sent back to me on the 12th of November (I was about to ask for my passport back for travel but wanted to check my application progress first).
They gave me a tracking number but the information is not yet available on the Royal mail website.

Hi Behold2014,

Same with me, I requested my two non-EEA passports back (current passport and expired passport with Residence Documentation) and they only sent me my current passport. I submitted another online form asking for my expired passport back - it's now been over 10 working days and I haven't received it yet. I'm not sure why they're holding on to it. I'm traveling in a few days for a family emergency (mother-in-law is dying) and I'm hoping I won't have to show my RC on my way back.

What do you mean by "no covering letter" . Did you receive your Certificate of Application? I sent in my application around the same time you did and I received my COA dated Oct 13th.
