Citizenship: Options for family members

Post by sojan » Sat Nov 08, 2014 10:53 am

hi
Posting on behalf of my friend
Situation
  • - He currently on ILR & will receive Naturalisation in May2015
    - He is planning to apply FLR for dependents (wife + 2 kids) . Kids born outside UK and currently based in India
CAn you please confirm if my understanding below is correct ?
  • 1. If he apply currently to bring his dependents to UK from India, he need to apply FLR for both wife & kids. FLR based on his permanent residentship (ILR)
    2. Supposedly everyone reach UK, once he naturalises, he could apply along with his kids. ie Kids move from FLR to naturalised/Citizen
    3. Once he is citizen, his Wife then needs to apply for FLR of Citizen?
    4. If he waits till May2015, naturalises then if he apply for his dependents from India; Kids would get Citizenship and wife will be on FLR?
Thanks in advance

  • 1. If he apply currently to bring his dependents to UK from India, he need to apply FLR for both wife & kids. FLR based on his permanent residentship (ILR) Yes and Yes, meeting the Financial requirement of £22,400 pa and wife to meet English A1 language to apply.
    2. Supposedly everyone reach UK, once he naturalises, he could apply along with his kids. ie Kids move from FLR to naturalised/Citizen No, kids will be required to have ILR before they can apply for citizenship because they are born outside the UK. They will qualify in line with your wife.
    3. Once he is citizen, his Wife then needs to apply for FLR of Citizen? No, spouse visa is the same for person on ILR and those who are British citizens.
    4. If he waits till May2015, naturalises then if he apply for his dependents from India; Kids would get Citizenship and wife will be on FLR? No, kids will get visa in line with their mother and extend after 2.5 years with the mother and after 5 years residence, apply for ILR for all dependents. Once they have ILR, only then can they apply for citizenship.
Thanks in advance

Thank you CR001 for the detailed reply.

Any chance for a document about the Kids (born outside UK) enroute to citizenship?

Also, he wouldn't be applying for FLR initially. He would be applying for a dependent settlement visa.

Hi there,

it seems that some really experts are replying on this thread so requesting information on my situation.

i applied for ILR in August 2012 with my son and wife which was rejected in March 2014. i appealed against the refusal and won the appeal. now i have received my documents back and also received letter in bundle which says that our BRP cards will follow within week.

so, my ILR application was submitted in August 2012 ( it was same day application but file was on hold for 2 years for someone's else sins). During the process, my daughter born in the UK on October 2012. i wanted to know the visa options for her. is she eligible for British passport directly or i have to go through naturalization route. also we have some travel plans in jan/feb 2015 so some idea about processing time will be helpful to take right way. can i apply for ILR for her? what would be documentation as i do not work currently and not having any maintenance funds ready too.

kindly reply..

thanks in advance
