Thx ninjaman.

Just so you know my PR was issued on 9 November. I called on 11/11 and was told my application was still in progress. I called again on 14/11 and was told my PR was sent on 12/11. I guess the application status will be under consideration until the PR is sent out.

Hi all, just want to share my experiance.

Eea4 unmarried partner

I sent my application for eea4 on 20/08/2014. And it was grant on 13/11/2014. I was scared at first because i have only sent fews support documents with me. I have seen many post that provide paper from the past 5 years , so i thought oh no , i may have not sent enough , prepare myself for rejection:(

I have sent my children 's birth certificates , my partner ID , 1 of my partner recent pay slip, 3 of our household bills and my passport...

Oh , also , HO had called my partner work place about a week before my PR was granted .

Good luck to everyone

Just over 2 months isn't a very long time. They can take up to 6 months after all. Just sit tight.

Did you get the COA?

Also, they probably will call the EU citizen's place of work. They can check.

Hi Guys

I`m new to this forum. I sent EEA3 & EEA4 Applications jointly on 05 Nov 2014 and received my Reference Letter dated 09 Nov 2014 but haven`t received COA yet. How long does it take ? Or is the Reference Letter and COA same thing ?

The 2 letters are not the same thing. The reference letter should be issued as soon as they receive your application and the COA is (normally) sent about 2 weeks later (depending on how busy they are) when they check your case. You could definitely write to them at the address that is on your reference letter. I did this.

If you're not in a rush for the COA, I wouldn't worry too much.

Help! Help!! help!!! help!!!!
To all who can help including moderatros!!!

I want to write a reconsideration letter for refusal reason as below: Just do not know how or where to start.
Note. I now have decree absolute!!!!
Any body who can should let me know I am looking up to especially moderators like Obie, vinney, EUsmile, ca funke etc, etc, who have been brilliant on similar cases!!!

Hi all

I am seriously laughing out loudly as I composed this comments.
reason is they ask me for feedback on their services. I simply wrote Assholes!!!

EEA4 submitted 15/08/2014 received by H.O 18/08/2014 COA dated 28/08/2014.

PR refused on the 18/10/2014 just received today.

Reason I divorced in a church so the certificate from the church is not acceptable.

They quoted Regulation 10(5)(a) and that '' you have failed to provide a valid divorce certificate and therefore there is no evidence that the marriage has been terminated and you cannot therefore retain a right of residence until decree absolute is obtained. The divorce certificate you provided is not a substantive evidence of divorce. This department need to see a decree absolute as evidence of your divorce. You have failed to provide evidence that you meet the requirement of regulation 10 (5) and you have therefore not retain a right of residence following divorce or that you have resided under the regulation for 5 continuous years to qualify for permanent residence. Therefore a decision have been made to refuse to issue the confirmation that you seek under regulation 15 (1)(f) with reference to regulation 10(5)''

background Married in June 2009 leaved together until divorce in Aug 2014.

Original post

My EEA4 submitted on the 15/08/2014
received 18/08/2014
payment taken 22/08/2014.
Now the waiting begins.
Can anyone advice how long and what to expect.
I got divorce this month from a local church not in a court although got married in U.K in a Anglican Church.
I submitted for every year since 2009 p60 for 5 years joint bills both gas and elec, water bills some payslips including the divorce certificate from the local church.
My passport, my p60 and tax returns forms
NO EEA National I.D or Passport due to refusal of helping
I have read some people saying without the I.D I will be refused is that correct?

Hi all,

I am very new to this forum and will appreciate positive feedbacks please. Below are the recap of my journey;

Came to UK in 2006 after my EEA Uncle who arrived in 2005.
I am an Extended Family Member of an EEA National
Lived together with Uncle and my wife had our first child in 2006 in Kent, UK
Both myself and wife applied for EEA 2 in 2008 and RCs were granted in 2009
I have being in work since 2008 till date I.e. Registered Self Employments (2008-till date) for myself and Wife with Tax Returns completed every year, PAYE Employment for myself and I am on a good salary since 2009 when RCs were received till date.
Left Uncle's House in 2009 to live with my family before bought our own 4-Bedroom House in 2011
I now have 3 Children all born in UK, own over £200,000 Property/Mortgage, pays all my bills regularly, volunteered in the UK Electioneering Campaign both Local and National and so on.
Relationship between myself and my Uncle have being up and down due to my resistance of domineering nature by uncle, constant arguments and jealousy.
Uncle separated from his family this year and told me this year August when he paid me condolence visit after lost of my parents that he would be living UK.
Since August this year, I have been unable to contact my uncle, moved out of his rental house and his telephone is not working anymore.
Solicitor advised that EEA4 Form (Retained Right of Residence) due to departure of my a Uncle from UK must be submitted for all the family.
EEA4 submitted on Nov.5th 2014
HO received EEA4 on the 6th Nov.2014
CC debited with full money for the whole family on 7th Nov.2014 with receipt received on 14/11/2014.
COA dated 25th Nov.2014 was received on 27th Nov.2014. (My COA and that of my wife read 'Employment can not be confirmed because we did not submit all original documents of the following 'evidence of my sponsor exercising Treaty rights' while my children COAs mentioned insufficient original Treaty rights documents and proof of their relationship with EEA sponsor were not submitted despite that they are my children and long and short birth certificates were submitted.
Email was also sent to me on the 26th Nov.2014 confirmed that our applications are being considered and that it may take upto 6 months.

Followings were some of the documents submitted with EEA4 Form;
Sworn Affidavit made reference to Reg.10 (5c and 5d(iv); 6a and 6b), Reg.15 (1 f(i) and f(ii) having satisfied Reg.7(3), Reg.6(1b,c and e) and Reg.8(4 and 6); EC Work Instruction Chapter 2 (s.7.1a and 7.1c) and Chapter 6 (s.2 and 6.2 Completion of 5 Years Residence after ror).
5 Years a Employment Payslips, P60s, HMRC Tax Returns, NI Contribution were submitted
UK Land Registry Documents, Mortgage Statement and Bank Statements
5 Years Council Tax Bills, TV Licence, Utility Bills, Education Records (children and my OU Degree Results Statement, Pension Documents, EHIC Cards for all the family
Birth Certificates, Marriage Certificates including those of my children and that of my late mother who was related to Uncle.

My Questions are;
Although I am an Extended Family Member of EEA National, Why COA with unconfirmed right to work and does it have any implication on my current work?
Can I request for a revised COA? Please note that they said that they will not revisit the term of the COA while my Application is being considered.
Having applied through ROR where my 5 Years Employment should be regarded as Treaty Rights, why quoted in the COA that I have not submitted all original Treaty Exercise Documents of my Sponsor who I have already informed that he has left UK
Having submitted all my children's BCs (Long and Short), why quoted in their COAs that proof of their relationship with EEA National were not all submitted.
How Long can it take HO before issuing PR please?
In 2012, I appealed against refusal to grant my mother in law a visiting visa and the appeal was granted and Visa issued. Could this have any impact?

Your prompt help and advise are very valuable and highly appreciated.

Thanks

Hey guys,

Just an update regarding our EEA3/4 application

We were called for an interview after requesting to prioritise
PR applications.
Were invited for interview which was held today.
About 90 questions asked from both of us, got couple of questions mixed up but everything else went smoothly.
Got the interview printed once we were done and noticed a couple of typing mistakes, a lots of spelling errors etc.

For example earning I told them 700/800 per month and she typed 700/800 per week and then 180/200 per week!!
But obviously interview was audio recorded so I hope caseworker may hear the tape to rectify/clear the misunderstanding.
Overall very confident. May hear something in a week or two.
Special thanks to Chaoclive who answered every query.

Will keep you lot updated.

Regards
