Calculating OUT of Country Days -Tier 1 General

Dear GURU's


Currently I have got Tier-1 General visa.I will apply for ILR in Dec 2015.

Date of Visa Granted under Tier-1 General :11 Jan 2011
Entry in UK :7 FEB 2011 (After Almost 25 Days of Visa Granted)

OUT OF UK :29/AUG/2011 13/SEP/2011 14 Days
OUT OF UK : 5/JUN/2012 24/JUN/2012 20 Days
OUT OF UK : 13/AUG/2014 18/AUG/2014 7 DAYS

Question 1: Do i need to add First 25 days after obtaining visa?

Question 2: If i start my absence from UK (14+20+7) = 41

As per my understanding i can be out of country upto (180-41)=139 days in 5 years stay to be remain eligible for ILR. Please correct if i am wrong?

Question 3: For how many days i can stay out of country consecutively if i have 139 days left ?

Your start date of continuous period is 11th Jan 2011, as you entered within the 1st 90 days.

You can stay out of the country for upto 180 days in any concecutive 12 months.
Read "calculating continuous period for ILR" from the UKVI site.

Sorry to stick my nose in. but i have similar enquiry about continuous period.

My scenario includes both WP & Tier 1

WP
Start Date: Jan 2008 - Ends Date: 31March 2010

Tier 1
First Visa : 31 March 2010 to April 2013 (before 6 April 2010 Rule)
1st Extension: May 2013 to May 2015
2nd Entension: May 2015 to onwards

Now i been outside of uk from March 2011 to 31 July 2012. (nearly 485 days)

Now my Question is can i apply for ILR on April 2017.

i have calculated my five years as below

May 2017 - May 2016
May 2016 - May 2015
May 2015 - May 2014
May 2014 - May 2013
May 2013 - May 2012 (In initial 90 days I was outside uk)

Do it make any sense? or my Initial entry is considered as 1 Aug 2012 (2nd time i enter).

As per your reply

My Continuous period start from the date on which my visa was issued.(Good

news for me )

Question 1: Can you please confirm that 180 days absence allowed is for 5 years stay or it get reset each

year?

Question 2 :Is there any restriction on number of consecutive days stayed outside UK in a single trip.(90 days consecutive or any other plz mention).

Question 3 : When the earliest can i apply for my ILR as per information provided?

I can only reiterate it is 180 days in any consecutive 12 month period. Have you read the "Calculating continous period" pdf from the ukvi site? Yet?

I have read the guidance you mentioned and i have two queries if it is possible for you to address.



1: I have a limited company and take salary and dividends. if someone spend 110 days in one stretch non work related does it break continuity as in the above guidance any leave has to be work related.

2: I had 2 trips back home to visit my family one 85 days in one stretch. and second 110 days in one stretch family visit again. is it safe for me to apply ilr or i will have to get another extension.

from the guidance i am clear that 180 days are allowed out-side but next sentence is it should be work related. please help thanks

it is now 180 days a year, so you don't have to worry
normally you start counting absences since the day you entered the UK, if you had never been present until then, it's not an absence.
