Notice before hearing

Post by silverpearlz » Mon Oct 14, 2013 11:01 am

Hi,

After a Long wait for my hearing I have received this notice about my hearing.

"To the Appellant and Respondent

NOTICE

We are writing to advise you that the hearing listed on 21st of october 2013 has been assigned to a float list. This means that you will have to wait until a court becomes available in order for your case to proceed. Unfortunately you may have to wait until the afternoon and there is no gurantee that your case will be heard.

However, you should still arrive at 09.45am on the day of hearing, as it is essential to attend court at this time, as every effort will be made to hear your case in Court. If you do not attend the case may be heard in your absence,

Please do not hesitate to contact us for any further assistance. "

Any advice as am worried that it might take much longer then I expected.

Has anyone else received this notice letter as well?

Any info please let me know about it.

Thanks and Regards,

dear sir,

It happens in exceptional circumstances when thy predict your case to have possibly been heard on date they assume there is gap or time for that but not guaranteed as letter says.

you should not be worrying about anything as it isn't related to what happens in the court room whilst hearing neither is related to anything falls in your derogatory. they want you to appear on the date at the right time if you get heard fine if not you will be allocated another day as they say.

it happens rarely that is why none of readers not yet got back to you ...

hope above helps..

Agreed. Some cases take less time to hear on the day. Floating list will be heard while there will be reasonable time gaps between substantive list of hearing. Be prepare for the day. There is a high chance to hear your one. Good luck mate.
Many Regards

oral hearing withdrawn one day before hearing

Post by silverpearlz » Fri Oct 18, 2013 12:27 pm

our hearing for tier 1 team application was scheduled on 21st October Monday and we just received a letter today, Friday, stating "considering the additional documentary evidence sent by the appellants, the respondent has decided to withdraw the original immigration decisions and associated Reasons for Refusal letters..". and that they will arrange for the claims to be reconsidered and for new decisions to be made in the near future...???

Any thoughts guys....we appealed and sent supporting letters for oral hearing in may and just appointed a representative in October, a barrister.
now they have withdrawn the appeal which actually sabotaged our chance as we were prepared for the hearing to win it. our reason for refusal was only " no landline number in contract"
team application PSW 50k in account here

any suggestions or ideas as of what would happen?? and when would anything happen??
THANKS

it seems this is UKBA's new trick.

there has been an increased rate in the number of appeals that have been withdrawn just few days before the hearing date.

silverpearlz
be prepared for a long, long wait.

now, the regime of backlogs due to pending applications is over. the in-thing now is 'backlogs' due to appeal decisions that are yet to be implemented.

Posting on behalf of Silverpearlz account. We as an entrepreneur team did everything ourselves. From business venture, ideas, business expos, contracts, money, visa processing everything. Did not pay extra anywhere until it became extremely necessary. We made our Evidence bundle ourselves and hired a barrister by last week before our hearing just to be at safe side. Since we were sure of the outcome from beginning we only paid 500£ each to just book barrister and to cover additional expenses as required by the Law firm. We were told that they will withdraw before hearing and we played that card (Barrister) at the end. To our amazement it worked out and we received visa shortly after in January. Just thought to update about it as its been awhile.

Things have been changed since then about visa so heres a comeback and lets crack on with it
