Telecommuting on YMS?

Post by Rejected » Wed Feb 11, 2015 8:26 pm

Hi everyone,
Just a quick question this time:

Is there any potential issue with having the YMS visa and working for a Canadian company from home in the UK (telecommuting)?

Thanks.

Not visa wise.

There maybe some complications with tax, but they can be overcome.

Hi wf,
Would you be able to point me to a resource that could help regarding the tax stuff? I will be working for a Canadian company and be paid into my Canadian bank account. I will then just being doing personal wire transfers to my account in the UK (if everything goes well).

From my understanding, if my money is taxed in Canada, it cannot be taxed again in the UK not only because it's not "income" but personal wire transfers, but also because I'm not being paid by a UK source.

Thanks.

You will need to talk to a tax professional for a definitive answer.

My understanding is that by virtue of you being present in the UK, you are required to pay income tax there. Because of double taxation agreements you will not need to pay tax on that income in Canada (as opposed to vice-versa which you have stated).

However, for some time after departing Canada you may still be tax resident there and I am not sure where you are supposed to pay it, but I think it is still in the UK.

See YMS Guidance notes:
Any work in which a YMS participant engages must be compliant with United Kingdom and European Union laws, directives and regulations.
