Hi everyone,

I need some clarification about my sickness leaves which I have to take when I was in India for 44 days from 8 Dec to 21 Jan, so can be counted across two years


During this period 2 weeks were unpaid leave but I was employed.

Can someone please help to clarify if this will cause an issue. I can get the letter from employer about it. But will the unpaid two weeks can cause any issue, does I need to mention such letter or clarification.

I have got NI history showing continous employment
Please note that I was employed and paid contiously in last 15 months.

Can senior member please help?

Get the letter from employer. Your 44 days leave - is it in the last 15 months prior to application. Just asking and this should not be an issue as long as you meet the points from PBS calculator.

Be sure that you are not having absences of more than 180 days outside the UK in the last 5 years.

No these partial unpaid leaves are 48 months back.

I will get the letter from my ex employer who will mention that I have took this 44 days vacation under their employment, but does it necessary for them to mention that two weeks were unpaid... Do they cross check it against 48 months old salary slip..

My immediate 48 months have vacation and all are paid and not crossing 35 days in an year. PBS calculation all fine.
Total absence 107 days in 5 years.44+32+30

Just need clarity on absences count for unpaid vacation outside UK. What clause my employer should include or it doesnt matter.

If it is 48 months' then don't bother. Letter from employer is not needed too but will be good to have. Even if this occurred in the last 15 months and you weren't paid, it does not matter. You will submit only 12 months payslips with your application. All it matters is do you have enough points and are your absences less than 180 days in 5 years.

Going PEO Croydon so better to keep it simple.

No more than 180 whole days absence are allowed in any of the five, four, three or two consecutive 12 month periods, depending on the category, preceding the date of the application for indefinite leave to remain (ILR). .....

its not 180 days during last 5 years....

It's as good as total 180 days in the last 5 years.

bmaru is correct. It's 180 days in any 12 months. Not in total for 5 yrs. any ways you are fine. I thought of clarifying to avoid confusion.
