Can both spouses income be counted towards maintenance.

Post by pakhtoon77 » Thu Apr 30, 2015 10:37 am

Hi everyone, I have got my ILR in feb2015 on 10 years basis. I had T1 ENTREPRENEUR and i had nearly 2.5 years left in it when i got my ILR. i have 3 dependants which includes my wife and 2 kids. one of my child was born in uk so i applied for his passport. However, my wife and other child is still dependent on T1 entepreneur. I have to transfer their visas from being T1 ENTREPRENEUR to dependent of a settled person and will need to show about 22 k income.
I can either show my income as self employed for 1 year or payslips for 6 months to get their status changed from dependents of T1entpreneur to dependents of a settled person.
my query is that can i show combine income of me and my wife towards 22 k . For example my wife earning 8000 and me earning 14,000.
Thanks

Combined income can be used for applications made within the UK to make up the £22,400 financial requirement.

Thanks CR001 for your prompt response. i have one other question regarding maintenance criteria. if some have a deficit in 22k,can he use his savings to counter the deficit and if yes , how much savings one need to cover the deficit of lets say 2000.
Thanks

Savings start counts from £16000

if u have saving of £21000

£21000-£16000= £5000/2.5 years= £2000

so u can add £2000 towards maintenance requirement

Thanks zee ali,
so according to your formula one needs to have 21k in saving held in account for 6 months to get a discount of 2k in maintenance fund. i was told for 60k savings in account for 6 months will mean i dont need any maintanence fund.

You can rely on annual income of £18,600 or if you don't meet that, you can rely on savings only of £62,500 held for 6 months minimum.
