Ok bare with me. I was born in Canada in 1986 to Canadian mother and British father. They subsequently married in 1987. In 1989 we settled back in UK and when we came over I was named child on father's British passport and mother's Canadian passport which also holds ILR. I was 3. Using these I was registered in school and doctors and the government I must assume as I got national insurance number automatically at 16. Anyway my father died of cancer when I was 10 with youngest child born in UK aged 5. I went to primary school,high school, sixth form,college all. In Powys,Wales. Obviously passports became expired in that time and as my father passed away and at this point I was diagnosed epileptic so couldn't travel they were never removed.the ilr however remained valid. 26 years later I have welsh daughter and now I have my medical problems and my daughter's medical issues managed I finally found a job that will give me ongoing support and occupational therapy support to keep my epilepsy from affecting ability to work. Sent all my documents etc couple weeks ago and was told that I have only proof of half the proof of right to work.of course this totally threw me so asked if would accept ilr even though I'm British too.as per 2014 rules, if outside EEA or EU they can no longer accept it.I have spoken to home office, immigration,hmrc, employer(NHS) etc and everyone agrees I'm British but won't tick the box without a document saying so. I asked best way to do this and was told form ns. Every time I spoke to someone they told me would take 10 days, 4-6 weeks and now up to 6 months. The home office today said as I'm British I should apply for passport. First person I spoke to at passport agency said she didn't know and will send email to someone and will get a reply to me in 72 hours.the second time I rang and explained everything said yes go ahead and send everything and go for interview and I don't see a problem. I'm so confused and shocked this is happening. I have birth cert and dads death cert both stating dad born in UK,parents marriage cert stating dad and grandparents born in UK, my daughter as born in Wales,Canadian passport with ilr in. My sister has stolen dads British passport with my name on and won't give back.I'm just so confused and lost and scared I'll lose job offer. I've never broken law,have done volunteer work while health was being sorted etc.I have lived in Powys,Wales 90% of my life

You are automatically British because your father was British otherwise by descent and he subsequently married your mother.

I know. :-( unfortuantly to tick a box to let me have my job offer I need something from home office or British passport before they withdraw offer which is in next couple weeks. I have my dads marriage cert,death cert and my birth cert all showing he and grandparents are British.in fact, through à quick google search I easily found five generations of my dads side including my British born full brother and apart from my brother,all through generations found they were all born in liverpool, but they cant accept any of my current documents to allow me to start work.very upsetting

Apparently the 2014 rules came into force not allowing to accept current ilrs on expired passports to stop forged documents being used. I would know how to forge anything if I suddenly went mad so I don't get it.my mothers last expired passport with my name on too even though Canadian was issued in London when I was 9,so obviously we are here legally.but passport agency says they don't hold records back from when I was a child so they can't find my fathers British one with my name on

It's odd, if you had an expired ILR. Were the UKVI unaware that you are British?

Note that if you are British or settled, then you daughter born in Wales may also be automatically British.

Sorry meant passport expired but home office accept that ilr is still valid

Had to google ukvi sorry.I have spoken to them multiple times the last couple of weeks and everyone has said they accept dual nationality in this country and have told me to first get form ns and then British passport as everyone there I have spoke to have agreed I'm British. The only reason I was put on my mother's passport too was that my father wanted me to be able to apply for Canadian passport as adult too.none of this would be a problem if my sister hadn't run off with my fathers British passport with me on as named child

You and your daughter should proceed with applying for a British passport or Confirmation of British nationality status as soon as possible.

British passport for me paid online,sending docs on Monday once counter signatory fills in filling her bit and signing back of photo

Uck missed call from passport agency.rang back and got a lady.I explained I had a voicemail from that number asking me to ring back.I explained everything and she said the problem with what you've told me is that your parents weren't married when you were born therefore you are not British without your father's passport, but because you've already printed off declaration apply anyway. They will probably ask for grandparents birth certificates and their marriage certificate but you are not British. When she hung up I rang back and spoke to someone else,explained my situation and the other call and she said I am British as is my daughter. I then asked if the time to process is still 3-4 weeks as that is what the nationality dept of the home office told me Thursday when I called then and she told me that's the fastest way seeing as I'm British.passport agency confirmed that length of time....stress!!

That may take another month.GRO have said delivery date of my fathers birth certificate is 18th may. Until then I have no clue when my grandparents date of births are. I know they were born in 1902/1903 but that's it. I dont know the full names of my great grandparents either. Again makes it so I don't meet timeline for my job offer. Wish everyone was told new rules as they happen grrr. And thank you

update: halle blooming luyah. after 2 months of the passport helpline and helpline email denying any passport records prior to 1991 and after british passport people refused to issue me a british passport due to the fact my dad changed his name legally 50 years ago and the change of name deed seems to be nowhere, even though i had marriage cert, my birth cert and his death cert confirming new name. i basically had a paddy and got my local assembly member,the first minister for the welsh government and the private office for the immigration minister on my side,all agreeing basically that them refusing without change of name deed is stupid as its not a legal requirement, i received a formal written apology from the HMPO and a week later received a letter from them lo and behold containing passport numbers from 1979 and 1988 and dates of issue of my late father and the records proving they received his change of name deed and changed his name on passport and that i was officially included on one of the passports and confirmed it was the passport i entered the uk legally on...da da da because i am british which is what i was trying to say all along. they are now still bending over backwards to finish processing my passport. and as i sent scanned copies of my docs to the nhs they are still holding my job offer as they are happy im british.
