Tier 1 (General) and dependant - ILR

Hi All

I am going to apply ILR in June 2015 under Tier 1 General route. My Wife got her 1st Entry Clearance on April 2012 and she came to UK on 28 June 2012. Since then we are living together. we got Tier 1 General Extension on back in 2013 together. After Extension She spent 175 Days outside UK continuously( she was in in India). She came back on April 2014. Can she apply ILR with me or she has to go for Extension ?

Also she has passed English Language Course. Which is Skill for life ESOL entry Level 3 & Awarding body is English Speaking Board ( International ) Ltd. This Body is not in the list of approved English language list but this qualification is recognised by Ofqual & it is in the Ofqual register of regulated qualifications. Can she apply ILR/ extension with this qualification or she has to pass another exam? e.g Trinity College or IELTS english language course etc.

Absences should be limited and for good reason, do you have evidence of a subsisting relationship for the period she was absent?

Hi Amber Thanks for your response. She went to India for family reason. While she was in India our address was same, Joint bank account was there, I used to send her money to support her through local Money exchange operator, I bought her return ticket from my Credit card, also before she travelled we checked with few people and they said she can stay outside uk less than 180 days for a 12 month period. Is this correct? Please advise.

Days away are counted on yearly interval basis. That is when you arrive 12 months is 1 year and so on so forth.
MOST IMPORTANT days away from UK relate to Main Applicant, i suppose that is you, right?
As Amber moderator said proof of cohabitation with wife needs to be provided like you say bank, address, emails, phoros while away, money sent receipts etc.
For English Tests..............from April 6 2015, New test from the HO list are a must, UNLESS anyone had given an Ealier Approved test Before April 5 2015 and applied with it.
Therefore from Easter Monday April 6 2015. NEW TEST LIST IS APPLICABLE.

If you argue in ilr application that another test is Ofqual registered. But not in the new list you are simply asking for a refusal.

Thank You for clearing my confusion on ENglish language.Yes I am main Applicant. This is not a problem she still has time to go for another test. Can she still apply ILR with me or she has to apply dependent visa ? she is here in UK since June 2012 on Tier 1 General Spouse Visa.

1. From my experience ilr application takes Long Time collecting docs, tests, doing proper Cover ltr etc etc. So start process soon
2. You can apply 28 days before the visa expiry. I take it thats June 2015 ?
3. Are you doing yourself or thru solicitor ? I did ilr application myself.....
4. From basic info i think your wife can apply with you. Frankly, must review the Full Time, Document trail to be sure.

No, it is for temporary migrants, ie entry clearance of extension applications.

Hi All I need a quick help. I got my 1st Tier 1 G visa on 22-10-2010 and it was valid till 22-10-2013. I have applied my extension on 24-09-2013 ( 36 days before leave expire) and got my extension on 08-10-2013 till 08-10-2015. I just want to know does it creates problem for me by the time of ILR application because i have applied my extension well before 28 Days.

First Visa 22-10-2010 till 22-10-2013 and applied for extension on 23-09-2013.

Extension 08-10-2013 till 08-10-2015.

First Visa 22-10-2010 granted & Visa Expire 08-10-2015.

As your 1st visa granted on 22 Oct 2010 and your 5 years will be complete as on 22 Oct 2015 . As per rules you can apply 28 days before to complete 5 years .

28 days before to 22 Oct 2015 will be 24th September 2015 So you are eligible to apply ILR on or after 24th September 2015.

Dear "Malik44" Thanks for your response. My only concern is because i have applied my extension application 30 days in advance rather than 28 days , so i am worried. kindly suggest me on this. Thank You in advance.

Hello dear Forum members, can some one please answer my query. I have applied My tier 1 G extension 30 days in advance so , when I get my extension it was 14 days shorter than the original date. e.g 1st visa 22-10-10 till 22-10-13 and extension visa validation is 08-10-13 till 09-10-2015. Does it effect me on the time of ILR?

I already explain you wont get any problem and you are eligible to apply ILR on or after 24th September 2015. As per rules you can apply 28 days before to complete 5 years so you are also not 14 days short.

It depends where you initial visa was granted. for out of country application, ILR eligibility is based on your entrance to country (UK) and not on actual visa data.

you need to answer
- Where did you get your inital visa, out of country or incountry
- if out of country, what is the exact date you entered UK

If you are applying for indefinite leave to remain on completing five years’ continuous stay in the
UK made up of leave as a Tier 1 (General) migrant and leave as a highly skilled migrant, work
permit holder, innovator, self-employed lawyer or writer, composer or artist, in addition to the
relevant documents in 12A, you must provide the following documents:

Evidence specified in section 9A of this form

For the period before you were granted leave as a Tier 1 (General) migrant, documents
showing that you met the relevant requirements of the immigration rules.

this has always been there

naturally it depends on what category you were in before tier 1
