Out of UK Time - Tier1G - ILR

Post by VijayUK » Thu May 28, 2015 10:50 am

Hi,

I am in UK from 5 years on Tier1G. But after my 1st Employment which ended in October. I tried to search Job in November but could not so I went to my home Country in November.

I searched UK Job from India in December and January.

As there was not much of vacancies available I could not get. But I got in Feb. In total I was out of work for 4 months. but out of UK for 3 months. As I am not employed how can I get letter ? Cover letter with Boarding passes will be fine ?

Let me know.

Dear Sr Members and Gurus,

Please can you help on this ? I read the rules and below is my understanding.

- As Long as we are below 180 days in the qualifying periods it is good.
- Being on Tier1 General ( Self Sponsored Visa ) a self declaration letter is good to submit if you are not in Employment
Guidance says " The absences must be consistent with or connected to the applicant’s sponsored or permitted employment " so I see it as Tier1 General Sponsor is self . Is my understanding correct ?
- I also read somewhere ( in one of the PDF from Home Office , I think its Immigration Rules 6 or 8 ) if you are looking for Job in UK during the break of Employment we will have to explain.
- Declaring a self sponsored letter, providing passport copy with stamps is fine for this prupose ?
- As Visiting Family and Friends as Personal Vacation does not fall under Compelling reason.

Lastly if I submit self letter which box i Need to tick in the application.

Kind regards
Vijay B

Dear Gurus,

Here is the one I read from " Immigration Rules Part 6A ".

" For periods where the applicant was self-employed or in business in the UK, or looking for work or setting up in business in the UK, a personal letter from the applicant detailing the purpose and period of absences in relation to those activities. ".

So looking for work is also considered as Absence ?
In case if we are out of Uk and lookin for Job in UK , can it be mentioned as well in self explantory letter ?

Please help

Regards
Vijay B

then i think you should be ok, because i also had couple of but short(3 weeks 2 times) unpaid out of UK absences in 2012
most recent change was on December 2012 wherein even TIER-1 General were included to provide any out of UK absence

In ILR mention that you were out before such change introduced in December 2012, and mention otherwise not in breach of visa rules & regulations. I believe you should be fine.

Just a generic query on subject: Does Visiting friends & family while unemployed have a potential pitfall as a reason? Trying to figure out how successful applicants articulated such absence? I did use those visit to discuss employment and business opportunities in UK but don't think I can provide any proof for same.
