Hi all,
I had posted the following thread earlier this year on Wed Apr 15, 2015.
“This is in relation to calculating my continuous 5 year period on Tier-1 General Visa.
Applied [In-country] by post for my Tier 1 General visa on: 04/11/2010
Tier 1 General visa approved. Valid from: 05/04/2011 to 05/04/2013
Applied by post for my Tier 1 General visa extension on: 04/04/2013
Tier 1 General visa extension approved. Valid from: 11/11/2013 to 11/11/2016
I intend to apply for ILR in 2016 under the 5 year rule. There have been no absences. My question is can I apply 28 days before 05/04/2016 [ 5 years from the day my first Tier 1 General visa was approved].
Although I do believe that I can but any reassurance from the moderators/gurus would really help."
I noticed a similar query recently posted in another thread:http://www.immigrationboards.com/indefi ... 88083.html
When I had applied for my Tier-1 visa on 04/11/2010, my visa was rejected due to an error made by the HO. I appealed in time and the appeal was allowed.
Following the discussion in the above thread my question is: Would I be eligible to apply for my ILR, 28 days prior to completion of 5 years from my first Tier-1 [General] visa application date [04/11/2010] or would it be 28 days prior to completion of 5 years from when my Tier 1 [General] was approved [05/04/2011]?
Moderators/gurus/experts can you please advise. If possible can you include some links which confirm the same please?
Thank you all in advance.
