Hi yes I am appealing mine was refused as I have to prove my step dad of 15yrs has British nationality I don't get why as I am the sponsor not him I can only think that they want to know he is here legally so I appealed beginning of july sent his british passport and certificate to them.

Very strange reason to refuse. Hope it all works out for you soon.

Shes a friend of the family she done my cousins case they were loaded she got here in 6 weeks.

She charging me a flat fee of £600

So you applied with the guidance of your solicitor, will be interesting to know what the reasons for refusal were.

Are you going to visit your wife for Eid and your birthday?

Yeah, best stay way from the heat in that case then. Have you spoken to your wife about the outcome or did she tell you about it? She must be upset as well?

yeah i told her shes upset i didnt want her going to the VAC and finding out there. :( :cry:

Best of luck everyone. It is surprising how many times Judges themselves make errors of law or judgement which get overturned, so I guess there seems to be an element of luck to it all.

It will probably be a lot quicker, though expensive, if he reapplied.

It's almost two months since your appeal and no news yet.

But if he can wait, then appealing is the way forward, cost wise.

i have a couple of questions:

will my wife have to do the harder english test and do another TB test

also me and my mom have a joint bank account £169,845,44 since november 15th 2014 (9 months i think) can i use this to exceed the minimum income threshold, and if i can how paylsips and bank statement do i have to show ?

From what I have read on the internet it is best to present all evidence at the time of application, however a lot of evidence can be considered after application but before time of decision but not things like a new English test or things that you are supposed to have before the application, after decision there is only limited amount of evidence that can be consider which is in terms of visits to spouse or lets say you miss one document in a sequence of documents to do with the same subject.

Out of appeals it seems that you have 50% chance of success.

shes done a A1 city & guilds already but now that they application has been refused will she have to do the new ILETS english course ?

Not necessarily, appeal and cases taking the same amount of time their still on April applicants and all April appeal applicants have received appeal notices, it just depends on situation if its minor appeal, as re applying can result in being refused for another reason as well as costs and getting all documents attested/in date

- she will only have to re do TB test if expiry is up, it is valid for 6 months, but if u r appealing then no she doesn't
- as you have the cash savings in yours and moms name it should be okay as u do have control over the savings, but online it says you or your partner jointly, so i'm not to sure u will have to get a 2nd opinion on this
-and u don't have to show payslips just bank statements 6 months showing the savings have been in the account, but u will have to declare where the savings have been obtained from

yes only things like bank statement, pay slip or correction of dates or names on employment letter etc u cant say i forgot English test here it is now

Savings must be either solely in your name or jointly with your wife. Your joint savings with your mother won't be considered.
